Afternoon Briefs: Senator airs suspicions of fake Kavanaugh probe; prosecutors sue senior living chain
Senator wants to know whether FBI probe of Kavanaugh was ‘fake’
U.S. Attorney General Merrick Garland should help facilitate Senate oversight into whether the FBI conducted a “politically constrained and perhaps fake FBI investigation” of then-U.S. Supreme Court nominee Judge Brett M. Kavanaugh, according to a senator’s letter. Democratic U.S. Sen. Sheldon Whitehouse of Rhode Island, a senior member of the Senate Judiciary Committee, wrote that the FBI appears to have done little to investigate Christine Blasey Ford’s allegations that Kavanaugh committed sexual misconduct at a high school party. Whitehouse said potential witnesses tried in vain to contact the FBI, and it appeared that the FBI did not review information gathered through a tip line. “This ‘tip line’ appears to have operated more like a garbage chute,” Whitehouse wrote. The Judicial Conference of the United States on Tuesday recommended that Congress create 79 new judgeships, including two on the 9th U.S. Circuit Court of Appeals at San Francisco.
According to a March 16 press release, caseloads in the district courts increased 47% since the last major bill creating additional judgeships was enacted in 1990. The increase is based on caseloads at the end of fiscal year 2019, before the COVID-19 pandemic affected case filings.
The proposal recommends creation of 77 new district court judgeships and two appellate judgeships. It also proposes that nine temporary district judgeships be converted to permanent status. The breakdown is here.

Ex-Boies Schiller lawyer was ousted from new firm in deplorable scheme to keep cryptocurrency fees, suit says

The former Boies Schiller Flexner partner sued for refusing to leave his new law firm is claiming that his ouster was a pretextual money grab in his own lawsuit filed Tuesday in Miami-Dade County, Florida.
Plaintiff Jason Cyrulnik claims that he was asked to leave the Roche Cyrulnik Freedman law firm in a “deplorable scheme” by Kyle Roche and Devin Freedman to take for themselves his share of the firm.
His share included “an enormously valuable firm asset a fee payable in cryptocurrency by one of the firm’s clients that only days before had suddenly appreciated exponentially to more than $250 million,” according to the March 9 lawsuit.
