McWhinney to buy distressed mall in Fort Collins McWhinney Real Estate Services Inc. has been cleared by a state judge to purchase the distressed Foothills Mall in Fort Collins. In filings made last week in Larimer County District Court, the Loveland-based McWhinney was approved to purchase the property in Midtown Fort Collins. The sale price was not disclosed. The Foothills mall was placed in receivership after the bank backing its construction loan filed a foreclosure demand in early December. Chicago private-equity firm Walton Street Capital and Greenwood Village-based Alberta Development Partners LLC, which developed and co-owned the mall, were delinquent on the $46.59 million remaining on the original $145 million loan.

OtterBox sues Miami individuals, company for alleged sale of knockoff Otter products – BizWest

FORT COLLINS Otter Products LLC and TreeFrog Developments Inc., both Fort Collins companies, have filed suit against three Florida residents, a Florida company and several unknown parties for trademark infringement and other allegations involving alleged illegal sale of Otter products or knockoffs. The case, filed in Larimer County District Court, alleges that Menachem Mendel Ichilevici, Andrea Ichilevici and Beny Ichilevici, all listed at the same Miami, Florida, address, along with TX Trading Inc., and 10 individuals identified as “John Does 1-10” have violated federal trademark law and have engaged in unfair business practices that violate Colorado law.  Otter, which sells its products using authorized seller agreements, contends that the Ichilevicis and TX Trading, a company registered to Beny Ichilevici, sell OtterBox and LifeProof products both registered trademarks of Otter Products and TreeFrog Developments using an Amazon storefront called “Mac N’ Cheese.”

New Scene Magazine sued by former owner – BizWest

Tommy Wood FORT COLLINS The owner and publisher of New Scene Magazine is being sued by the publication’s former owner over allegations of nonpayment, according to a lawsuit filed Friday in Larimer County District Court. Blaine Howerton, the owner and publisher of New Scene Magazine and North Forty News, is accused by Michael Mockler, former owner of Scene Magazine, of failing to pay Mockler for the sale.  “It’s all a surprise to me at this point,” said Howerton. “I can say that we have done everything in our power to keep this magazine going.” Howerton said that as of Tuesday afternoon he had not yet been served with the lawsuit.
