What the Capitol siege means for the future of security clearances

© Getty Images As law enforcement authorities continue the process of trying to identify the thousands of U.S. citizens who stormed the U.S. Capitol Building on Jan. 6, longer-term questions remain, such as how the federal government can protect itself against radical and violent extremists attempting to gain national security clearances.   The violent assault on the Capitol – intended to disrupt the certification of the 2020 presidential Electoral College results – resulted in violence, loss of life and destruction of federal property. Multiple members of known extremist groups – including The Oath Keepers, Proud Boys and QAnon – were part of this attack. The  FBI has already made more than 100 arrests across several states connected to the assault on the Capitol, with more expected in the coming weeks as the FBI parses additional information gathered from images and videos taken inside of the building. 

Contractors Have Six Months to Comply with NISPOM Regulation

Thursday, January 28, 2021 On December 21, 2020, the Department of Defense (“DoD”) published a final rule in the Federal Register that codifies the National Industrial Security Program Operating Manual (“NISPOM”) in the Code of Federal Regulations (“CFR”) at 32 CFR part 117. The rule will become effective on February 24, 2021, giving contractors six months from the effective date to comply with the changes. Comments on the proposed change are due by February 19, 2021. [1] The NISPOM establishes various requirements and standard procedures for the protection of classified information disclosed to or developed by government contractors. It was first published in 1995 as DoD Manual 5220.22, and was intermittently updated through the years including (most recently) via Conforming Change 1 on March 28, 2013, and NISPOM Change 2 on May 21, 2016. In addition to adding the NISPOM to the CFR, the new rule will incorporate the requirements of Security Executive Agent

     By the authority vested in me as President by the Constitution and the laws of the United States of America, and in order to establish an advisory council on science, technology, and innovation, it is hereby ordered as follows:      Section 1.  Policy.  As directed in the Presidential Memorandum of January 27, 2021 (Scientific Integrity and Evidence-Based Policymaking), it is the policy of my Administration to make evidence-based decisions guided by the best available science and data.  Officials and employees across my Administration shall seek from scientists, engineers, and other experts the best available scientific and technological information and advice.      Sec. 2.  Establishment.  (a)  There is hereby established the President’s Council of Advisors on Science and Technology (PCAST).
