On April 7, 2021, a majority of both houses of the Virginia legislature voted to legalize adult recreational use of cannabis. The approval made Virginia the 16th U.S. state – and the third state this year – to legalize adult recreational use of cannabis. Under the new law, home cultivation and personal possession of cannabis will become legal July 1, 2021, but retail sales will not begin until January 1, 2024.
Virginia Senate Bill 1406/House Bill 2312 legalizes the retail sale of cannabis products to adults over the age of 21 and establishes the Virginia Cannabis Control Authority to oversee the cultivation, manufacture, wholesale, and retail sale of cannabis and cannabis products. Virginia becomes first southern state to legalize recreational marijuana
RICHMOND – Following yesterday s legislative approval of Democratic Governor Ralph Northam’s amendments to Senate Bill 1406 and House Bill 2312, Virginia becomes the first southern state to legalize the possession and use of marijuana by adults, according to a release from Virginia NORML.
Senate Bill 1406, introduced by Sen. Adam Ebbin (D-30) and Senate President Pro Tempore Sen. Louise Lucas (D-18), and House Bill 2312, patroned by House Majority Leader Delegate Charniele Herring (D-46), establish a statutory timeline for the legalization of the commercial marijuana market in Virginia.
The measure also permits for the personal possession and cultivation of cannabis by those ages 21 or older.
RICHMOND, Va. (April 8, 2021) – Yesterday, the Virginia House and Senate gave final approval to a bill that legalizes marijuana for adult use this year despite ongoing cannabis prohibition.
Sen. Adam Ebbin (D-Alexandria) and Sen. Louise Lucas (D-Portsmouth) introduced Senate Bill 1406 (SB1406) on Jan. 13. Del. Charniele Herring (D-Alexandria) along with a large coalition of Democrats introduced the House companion, House Bill 2312 (HB2312). Under the law, adults 21 and older can purchase and possess up to 1 ounce of marijuana and cultivate up to four plants without penalty. The legislation also creates a regulatory scheme for the commercial cultivation and retail sale of cannabis. The law establishes an independent agency called the Virginia Cannabis Control Authority to establish a regulatory structure for the adult-use market. The bill includes provisions to create a process for the expungement of records relating to past marijuana crimes.
