Belgium condemned by European Committee of Social Rights for failure of inclusive education for children with intellectual disabilities 03/02/2021 On Wednesday, February 3, 2021, the European Committee of Social Rights (ECSR) made public its decision regarding the complaint brought by the International Federation for Human Rights (FIDH) and Inclusion Europe v. Belgium alleging that by failing to make sufficient efforts to promote the inclusion of children with intellectual disabilities in mainstream primary and secondary education provided in schools attached to the French Community (Wallonia-Brussels Federation), Belgium has failed to comply with the obligations resulting from Articles 15 (the right of persons with disabilities to independence, social integration and participation in the life of the community) and 17 (the right of children and young persons to social, legal and economic protection) of the revised European Social Charter.

Belgium condemned for excluding intellectually disabled children from mainstream education

Education 10:15 04/02/2021 The European Committee of Social Rights has publicly condemned Belgium for failing to include children with intellectual disabilities in mainstream education. The decision followed a complaint by a collective of parents, represented by Inclusion Europe and the International Federation of Human Rights Leagues (FIDH), with the support of Unia and the Delegate General for Children s Rights. After four years of legal battles, the Committee has now ruled in favour of the claimant organisations and thus condemns Belgium, and more particularly the Wallonia-Brussels Federation, for the lack of efforts made for the educational inclusion of pupils with intellectual disabilities. The European Committee on Social Rights concluded in its judgement that the right to an inclusive education is not guaranteed in Belgium. Education 10:22 29/01/2021 Schools across Wallonia have been slowly crumbling due to lack of maintenance for years now with buildings deteriorating, toilets running inefficiently and many classrooms lacking adequate insulation. This could all change soon as the government of the Wallonia-Brussels Federation sets out on its mission of large-scale renovation of schools as part of its current legislature. Frédéric Daerden, the budget minister who is also in charge of school buildings, estimates the cost to renovate the whole school network as between one and two billion euros. A colossal sum for the Federation Wallonia-Brussels which is far from rolling in money. But two major avenues of financial revenue have already been established.
