Appellate ruling keeps fatal Troy shooting case on track for trial
Judges rule evidence supports allegation officer would have known his actions unlawful

ALBANY A federal appeals court has rejected an appeal by the city of Troy and the widow of a patrol sergeant who fatally shot an unarmed DWI suspect in 2016. The decision upholds a federal magistrate s prior ruling that found there were material questions of fact about the shooting that should be resolved by a jury trial.
The ruling by the U.S. Second Circuit Court of Appeals also declined to grant qualified immunity to the deceased sergeant, Randall French, because eyewitness testimony called into question the officer s claim that the shooting was justified.

There is absolutely no role for natural gas in New York’s renewable energy future. We need to make polluters pay for their assault on our public health, not continue to aid and abet their crime against humanity by letting them expand fossil fuel infrastructure.
New York state needs to follow through with the Climate Leadership and Community Protection Act. The act does not include the expansion of fossil fuel plants between now and 2040; it states that we need to phase them out. We need to deny all new proposals for fossil fuel infrastructure like the Danskammer plant in Newburgh and begin shutting down all existing fossil fuel power plants. Gov.
