Paralyzed man files suit after allegedly defective tree-trimming harness drops him 50 feet

(Legal Newsline) - Hi Tech Tree Trimming and owner Homer Smith were sued in the Washington County Circuit Court of Arkansas after a harness allegedly failed and dropped an employee 50 feet out of a tree.  The complaint was filed on April 21 by Thomas Gragson of Fayetteville. Gragson was working on a tree-cutting job in Wedington Woods on July 22, 2020, and was using a harness owned and provided by the defendants while working. Gragson says the harness was defective and dropped him 50 feet out of the tree, causing a broken arm, ribs and hip, as well as a punctured lung and a fractured spine resulting in paralysis from the waist down.

The penalty against Erik Graeff, who was admitted to the Oregon State Bar in 2010, resulted from three incidents a few years ago, one of them criminal.

Lawsuit: Arkansas woman crushed by railroad ties seeks payback from Tractor Supply

(Legal Newsline) - An Elkins, Ark., woman called out Tractor Supply in the Washington County Circuit Court after her legs were allegedly crushed by railroad ties at the farm retailer s Springdale location.  According to the complaint filed on March 19 by plaintiff Donna McDaniel, she was shopping in the Tractor Supply with her husband on June 2, 2018, for railroad ties. McDaniel says she was instructed by one of the defendant s employees to use a pair of tin snips to cut open a bundle of railroad ties, which are held together by a metal band.  When McDaniel cut the band as instructed, the force of the heavy bundle exploded outward and caused four of the ties, which weigh over 200 pounds apiece, to land on her legs. McDaniel s injuries, including bone fractures, required surgery.

Conservative Justice Annette Ziegler will be the next chief justice of the Wisconsin Supreme Court after she was elected to job by her colleagues Wednesday. Ziegler replaces outgoing Chief Justice Patience Roggensack, a fellow conservative who did not seek reelection to the post but remains on the court. Ziegler’s first day as chief justice will be May 1. Roggensack was first elected chief justice in 2015 after Wisconsin voters approved a referendum changing the way Wisconsin picks its chief justice. Previously, they’d been chosen by seniority, but under a constitutional amendment narrowly approved by voters, future chief justices would be elected by their peers on the court.
