President Duterte’s order to defer the implementation of the Child Safety in Motor Vehicles Act (Republic Act No. 11229) is a welcome news but this would require a new law to be enforced, House Deputy Speaker Rufus Rodriguez said on Thursday, February 11.

“It’s Congress that passed the law requiring child car seats, and it’s Congress that can suspend its implementation,” Rodriguez raised in a statement, even as he lauded Duterte’s decision to suspend the so-called child car seat law.
He also said that a joint resolution from the House or Representatives and the Senate will not suffice since the Supreme Court (SC) previously ruled that such piece of legislation cannot prevail over a law.

The Cagayan de Oro second district representative in a statement said this applies to any chief executive of the country, noting that the Charter does not provide for their participation in the constitutional amendments.
“The Charter does not give the President any role in the process of proposing and ratifying constitutional amendments. It is Congress, as a constituent assembly (Con-Ass), or an elected constitutional convention that proposes and the people ratify or reject the proposals. These are the first two Cha-cha modes under the Constitution,” said Rodriguez, who previously chaired the House Committee on Constitutional Amendments.
