The days of South Dakota governors holding the authority to fill vacant legislative seats could be numbered. That s because a group of lawmakers in Pierre are working a bill through the Legislature to put the question of appointment authority before South Dakota voters during the next general election. Right now, the state Constitution gives the governor sole discretion to make appointments when an elected lawmaker is unable to continue serving, whether that be through resignation or death. Gov. Kristi Noem, for instance, has made at least eight appointments since taking office in 2019.
