House Bill 969 passed Wednesday in the Florida House’s Commerce Committee, and moves on to the full Florida House for a floor vote. HB 969 is similar to the California Consumer Privacy Act, and to its Florida Senate bill counterpart, Senate Bill 1734, with a critical difference. HB 969 creates a private right of action for consumers against any company that fails to comply with a consumer’s request that the company delete, correct or stop selling the consumer’s personal information, and provides for prevailing party attorneys’ fees to a plaintiff who successfully sues a company under the law. On March 25, the heads of the big tech trio Facebook, Google and Twitter testified before the House Commerce Committee, defending their Internet platforms against fierce attacks from lawmakers on both sides on the companies’ content moderation policies and practices. While the Democrats and Republicans may differ on the nature of the shortcomings of Section 230, there appears to be a growing consensus among lawmakers that Congress should take action to make big tech accountable for conduct taking place on their platforms.

But it didn’t matter and the 20 Key West residents who testified against the bill were dismissed by the bill’s sponsor, who implied they don’t represent the rank-and-file of Key West. “You heard a lot of passionate testimony today from the side that could get up here, said Sen. Jim Boyd, R-Bradenton, “but the side that couldn’t get up here that’s down there struggling to make ends meet are who you didn’t hear from.”
