The regulator investigated the company after a former employee, who had been employed as a property manager, lodged a request for assistance. A Fair Work Inspector issued a Compliance Notice to Darrell Crouch & Associates Pty Ltd in January 2021 after forming a belief the employee had not been paid his entitlement to payment in lieu of notice when his employment with the company ended in 2019.

The cafe worker was allegedly owed minimum wages for seven days of work performed in July 2020, as well as penalty rates for weekend work under the Restaurant Industry Award 2010. Prior to commencing legal action, the FWO made several attempts to secure voluntary compliance, in line with the regulator’s approach during the COVID-19 pandemic. According to FWO, the company allegedly failed to comply with the Compliance Notice, without reasonable excuse. The café manager Diaa Mohammed was allegedly involved in the breach.

The regulator commenced its investigation of the café after an employee, an international student from the Phillipines, lodged a request for assistance. A Fair Work Inspector issued a Compliance Notice to Blue Mist Entertainment in September 2020 after forming a belief the employee had not been paid any wages for seven days of work she performed at Blue Mist Café in July 2020.

Date Time Wellways Australia signs Enforceable Undertaking Mental health, community care and disability services provider Wellways Australia Limited will back-pay staff more than $1.5 million after entering into an Enforceable Undertaking (EU) with the Fair Work Ombudsman. The not-for-profit organisation first self-reported underpayments to the workplace regulator in September 2020. After being prompted by an external review of its payroll function and a pay query from an employee, Wellways discovered it had underpaid more than 500 current and former employees’ entitlements under the Social, Community, Home Care and Disability Services Industry Award 2010 between 2014 and 2020. Underpaid employees were located across Queensland, NSW, the ACT, Victoria and Tasmania. They included full-time, part-time and casual employees.

Date Time Trolley collecting operator faces court The Fair Work Ombudsman has commenced legal action against the operator of a trolley collecting business in regional NSW for allegedly breaching a Fair Work Commission order. Facing the Federal Circuit Court is Mahmoud Hasan Abulamoun, who operated a trolley collection business at the Green Hills East Maitland Shopping Centre. In August 2020, the Fair Work Commission found that in May 2020, Mr Abulamoun unfairly dismissed a trolley collector he had employed since September 2018. The Fair Work Commission ordered Mr Abulamoun to pay the worker $2817.39 compensation. Mr Abulamoun subsequently appealed unsuccessfully. The employee lodged a request for assistance with the Fair Work Ombudsman after the company allegedly failed to pay the compensation.
