Hong Kong: Detention policies explained
The Immigration Department today reiterated that the detention of illegal immigrants, overstayers or people refused permission to land in Hong Kong complies with the relevant legal requirements and principles established by the court.
According to the prevailing detention policies, the department will consider all the facts and circumstances of the particular case when determining whether an individual should be detained.
These include whether the person concerned has committed a serious crime or is likely to pose a threat or security risk to the community if not detained, and whether there is any risk of the person absconding or reoffending.
