Neighbors react to decision to fire 4 HPD officers following Nicolas Chavez shooting
HOUSTON – The family of a man who was killed in an officer-involved on April 21, 2020, has filed a $100 million civil lawsuit Tuesday, according to Sean Roberts, the family’s attorney.
The lawsuit follows a day after Houston Police Chief Art Acevedo announced his departure from the department. Acevedo was sworn in Monday morning as Miami’s new top cop.
The lawsuit lists Chavez’s three minor children, his parents, Joaquin and Leantha Chavez, and wife, Jessica Chavez, as plaintiffs. Alongside the Houston Police Department, the lawsuit also names the city of Houston, all five officers involved in the shooting Luis Alvarado, Benjamin LeBlanc, Kevin Nguyen, Omar Tapia, and Patrick Rubio as individual defendants.

On March 3, police shot and killed a man suspected in a string of aggravated robberies, who HPD officials say was trying to steal Smalls car from a Chevron gas station at Beechnut Street and Southwest Freeway after a chase.
The 19-year-old mother said the man told her to get out, but that she wouldn t because her baby was in the backseat. Police quickly surrounded the vehicle.
Police said the officer, identified only as 15-year veteran E. Garza, opened fire after the man refused to drop his gun and that he was worried harm would come to the mother or her baby.

A one-year-old boy is “fighting for his life” after a police officer shot him in the head while pursuing a suspect linked to robberies.
Baby boy Legend Smalls has had part of his skull removed and suffered more than ten seizures, according to his family, as he holds on to life two weeks on from the shooting.
The March 3 shooting happened at a petrol station in Houston, Texas, where a man armed with a gun got into a car while Legend was in the back seat.
Mum Daisha said she was sat in the car when the man jumped in – though the Houston Police Department claimed earlier this month she was not inside when the shots were fired.
