最低工資的主體法案立法已於本年7月於立法會獲得大比數的通過，這對爭取多年打工仔確是一件好事。然而，法案對殘疾人士享有最低工資的保障，卻有特殊的安排：如欲享最低工資的保障殘疾人士，需要進行生產能力評估，有關評估結果會用來斷定殘疾人士應享有多少個百分比的法定最低工資水平。誠然，這個打折扣的安排將殘疾人士剔出最低工資的保障之外，明顯地假定殘疾人士的工作能力必定不如一般勞動者，令不少殘疾人士感到屈辱。.

我們認為共融平等的社會是強調傷健一家，但今時今日的香港，政府仍然推出殘疾人士與健全人士有不同的對待，殘疾人士需要額外地面對一個評估的機制，而這個機制是令殘疾人士看似「合理地」去接受一個低於法定最低工資水平的待遇。這種安排無可避免地面對兩個原則性的挑戰：一，這還是真正的最低工資嗎？二，共融與平等的價值還存在嗎？.

現時殘疾人士因缺乏就業機會而出現嚴重的就業不足。據統計處的四十八號報告書顯示，在全港34萬殘疾人士中，只有13.4%的人從事經濟活動，沒有從事經濟活動的殘疾人士有近87%，是最近政府公佈4.3%失業率的20倍。這個數字足以顯示保障殘疾人士的就業機會是整體社會刻不容緩的議題；政府對殘疾人士就業的鼓勵是嚴重不足。現時香港沒有殘疾人士就業配額的保障，徒有最低工資的立法，對殘疾人士而言，只有被逼接受一個難以接受的待遇，造成貧者愈貧；困者愈困的不公局面。.

對任何人士來說都是一樣的，辛勞所得的工資都不能營生的話，只會打擊他們公開就業的信心。殘疾人士是熱衷於參與工作，因為工作是體驗生活及自我肯定的重要一環，如果社會上就業機會少，所得工資還遠低於最低工資，對有心投入工作的人都是一種打擊。在此種意義上，政府的補貼令殘疾人士享有等同最低工資的保障，是更大的鼓勵殘疾人士投入工作，長遠而言，在社會保障的支出亦會減少，對政府、僱主及殘疾人士三方面都有好處。.

俗語說，魔鬼在細節之中，對此評估殘疾人士的機制我們存有種種的疑問，如何公正合理地量度殘疾人士的工作能力，什麼的工種應用怎樣的標準去衡量，我們都存在疑慮。最值得擔心的是，在權力不平衡的僱傭關係下，評估機制演成壓價及濫用的工具，故此，應在評估的制度下設立合理下限以及制衡機制，以確保公正合理地運作。.

基於上述社會現狀及法例的不足之下，我們提出以下四點建議，以糾正錯漏，彌補不足。.

1. 要求殘疾人士同樣可享健全人士有最低工資水平，若殘疾人士接受生產能力水平評估後，被評定不足100%生產能力，政府應提供補貼至100%水平，上限50%。 .

2. 受生產能力水平評估之殘疾人士在一般而言不會被評定為最低工資的50%，倘若被評定50%以下，政府應提供第二次的評估，以確保殘疾人士工作能力不被低估，造成不公。 .
.
3. 對於殘疾人士現有工資已達或高於最低工資水平，政府不容許他們再評估，以免殘疾人士被受僱主壓力而主動作出評估 .

4. 政府應立法制定殘疾人士就業配額制度，要求50人以上之企業及團體，需要聘請不少於2%的殘疾人士 .

我們相信，如果政府能夠做到以上四項，才能確定保障最低工資的好意，不致變成殘疾歧視的壞事。.
