Amanda jo, good, and almira nance for both 16. Robert manning was 22 gave on their gun and they both went into the radio shack armed amanda waited in the car. The manning leader testified that he killed the manager with a shot to the head. Even though im your nance didnt pull the trigger. He was convicted a felony, murder, and sentenced to a minimum of 51 years in prison. Hes 43 years old. Now. Ive been here to my whole 2030, and i havent been outside of it. When i say count them, i gotta go in room. They locked the door and come out. Im missing my, im missing the, were missing the dog. Im here actually represents so many people that were just there and theyre held accountable for things that technically they did not do. Tennessee has the longest mandatory sentence in the United States for a teenager convicted a felony murder as or 16 or 17 if theyre carrying that on. And i know theyre not supposed to have a gun and theyre involved in a criminal act. They know thats wrong. And you, you cant afford to let those people out fault lines travel to tennessee, as the state Supreme Court considers whether these 51 year sentences violate the constitution. Its unfair. Its like theyre trapped there and some sort of nightmare that they cant get out. My daughters brian. Shes in our twenties. Ive been in prison. Her whole life. Shes never know me outside of a visitation. Got it. You dont want to give them a chance to like become a better person for his family. 51 years before, for ro is ridiculous. Who is the point . Been in prison, more used to not been for you on the street. I wasnt old enough to buy cigarettes when i was old enough to you from the way for him to be punished. Hes 51 use. What kind of just system is in the me. On january 18th, 1996, the day of the shooting, Robert Manning showed up to all mirrors house and flashed a pistol in the car. I need you to help me go out of the way to get some money. I gotta get out of what i remember most about robert planning is that he had no off sledge. That was always struck by the fact that he seemed to have no conscience at all. He did not seem to have true. Lar, several grand, for anything you do. And then my name is incredibly dangerous. And do you remember your body shut or are you mad . Its Robert Manning had a history of violence. He had shot an injured one of the mirrors, friends earlier that day. And again, air made me laugh at me. My son was afraid for his life in here. Every right to be afraid. No fear. I probably would have gotten a call back saying, i dont know. And amanda was the other teenager in the car that day when the truck, she asked us not to show her face of them. Do you have any memory of whether ill near wanted to come along to do this thing . I think its the same as me. He had no idea what was going to turn out the way that it did. And i do know for a fact after that he did tell me or wait right here with her, come with me on there, sitting the car with her around there. So you can kind of imagine maybe what the conversation was, why the after the shooting, the group propped home nearby and tied up the couple. Locking them in the trunk of their car. Now my brain and ran and i was serious trouble from the router mannings. Pulling the strings from the get go, decided that they would go over the right ear sheka. Shes tall, and that was always my sense about both those young people is that for Robert Manning need, or they can sort of have been in this situation. The subject being interviewed lee, a black male subject named el near nance. Almost a week after the suiting amir nance was arrested in the middle of the night and interrogated at this Knox County Sheriffs Office building a 16 year old without a parent. Without my permission for data, tony 8 and 9 officers kept with me now all night long. Subject to this interview will be the homicide which occurred on their told police that robert man, until joseph. Right. Are you sick . I would know that i like time trying to run at the store and when i was like at the door, the door open and i heard a shot. A mirror says he repeatedly asked for a lawyer that night, but never got one. In life. They told me they were going to call the lawyer, they were trying to get it open at the end of the day. It was not, it is a 160. 00 kids been woken up at gunpoint with dogs cut off from his mother. And he still shows the presence of mind to invoke council. I want a lawyer. We reviewed the trial transcripts with chris erwin, a former public defender, and imani, informed me, an activist in knoxville unit in court. The officer who questioned down there and testified that he didnt recall him asking to see an attorney and the officer lied when he was on the stand. Under oath, did he invoke counsel . He said, no, no, he did not. He comes back with his notes and hands and he goes. So he did and focused right to counsel the officers own hand. Written notes contradicted his testimony under oath, but the judge refused to throw out al me, your statements to police. What impact does not have on the rest of this case, when you have some 16 year old talking about his involvement. If you just said anything, the constitutionally, the statements obviously should have been suppressed, was obviously a coursed confession. I couldnt even explain to you a sorry, i feel i expect no, that to happen. They are really a no, not a bad thing. So be the end of this interview with al moon. And initially Robert Manning blamed the shooting on l mirror, but he later testified in court that he pulled the trigger shot Robert Manning was sentenced to life without the possibility of parole. While in prison, he stopped at mann and set him on fire, killing him. He did not respond to any letters from salt lines. The mirror was sentenced to a minimum of 51 years. That wasnt the case for the 3rd person involved in the robbery. Amanda jo, good. She did. How much time in jail . 50 years, 40 years, 10 years. She did one year she was incarcerated. Whats the difference between her and the person who has a doctors getting color is going to get more time that has been proved and you had a white judge, white prosecutor, White Defense attorney white cops, and then you have this flat kid sitting there 16 when it happened and gets nailed. The color of his scan was not my concern. And never was ready. Nichols was the District Attorney at the time and oversaw the prosecution of im yours case. Dont you see a double standard . And the way that a 16 year old white girl gets a year. How do you explain that . Well, uh i can explain it. Uh, you know, and like say people wish to draw the conclusion that it was uh, racially motivated. They would be free to do that. The only thing i can say is thats just not the way it was. He got out of the automobile and went into the store. She did not a secondly, he had a hand gun. She did not. Weve tried to base our decisions on the facts that we could prove in court. And i believe i did that in this case. Do you think that a juvenile who doesnt actually kill anybody . Should go into prison as a teenager and come out as a senior citizen. As you look at it in know some 30 years later for chance it was overly harsh. I wouldnt argue that, but continue to be able to live with glad to see on this case right or wrong. So were on our way to the old knox county courthouse to meet with her and on the nurse trial. This year in particular is said that really wanted to talk to i, she said that shes been thinking about this case for 25 years and have been feeling guilty for 25 years. I dont feel like what we did was just best to serve. When this sentence was pronounced and we again, i really nice i, i thought the jury would have some input to the half. Do you remember how you felt when you heard this 51 year minimum center . I was done, shot your life was taken and that is a terrible tragedy of great injustice to the victim whose family has all the people whose the ripples of his life would have gone out to for generations. But taking mirrors when he just started in and wasnt even formed into who is going to become yet really i felt horrified. No feel like i follow the instructions. That wall wasnt, as i regret being the teacher asked us not to use her name because shes concerned about possible backlash for sharing her feelings about on the or sentence it was like a death blow. It was like over to leaving, you know, its just a scrolling usual if you think about it, definitely if the point you are doing in of course it was definitely in humane and it was no just no just served. No bad. He looked him lucky was nothing and named no, he didnt deserve. And they didnt care. They didnt care. Hello, this is a prepaid call for an inmate that the Tennessee Department of corrections, northwest correctional complex. Hello. Hey, l as in todays is done this way and that is to send them to the 1st time and the same tough guy. Energy just went away. They havent really seen them in a while and actually i have to just have him home. Hes never, if it was just for a few hours, you know, as let us go do something together. Anything. What goes through your head when you think about the fact that your dad is serving a felony, murder, senate and didnt murder anybody . It just makes me like i realized that the system does not always work the right way. They know that i didnt shoot this person. This man joseph bride is like to say his name. I dont like to just say the person on the picked him. Id like to bring the father man by me saying his name, but they know i didnt kill this person can be charged with felony murder if they take part in a crime in which someone is killed, even if they didnt cause the death. United states is one of only a few countries in the world with such a law felony, murder doctrine in and of itself is a fiction because it transfers the intent of a felony which is not monitor. And they shouldnt be treated like they intended to kill. Because they did, through a series of rulings over the past 20 years, the Supreme Court has concluded that juvenile is convicted of murder should be sentenced differently than adults. Nearly 12000 people in the us are serving life sentences for crimes. They committed as the juvenile, juveniles are different because of they are sort of uniquely susceptible to peer pressure is from outside. They have a greater capacity for change in growth overtime. Their brain is not fully developed until theyre 2021 between 21 and 25. So we know a lot more about brain development. And if that juvenile is thinking like an adult, or if theyre thinking like a child, you dont really understand things like at that age of 16, you dont think life as like family, or you know, in your norfolk things right now today. And next week. Since 1995, 236 juvenile offenders and tennessee have received 51 year minimum sentences. 72 percent of them are black compared to just 17 per that as a states population. All of these factors, race, peer pressure, useful Decision Making and a difficult childhood played a role. And on the worst case, i grew up in a drug addicted home. My mother was on drugs. My father was absent. I spent a lot of time living with my grandmother, so i was really a kid. I had no big brothers. I had no father figure. So i wound up hanging with older guys and doing things that i should have been doing and. And i was easily manipulated you know, you blame yourself and feel like you want to didnt amount, but i need to be a 2nd. When i know i never want a job again in my life. It cost me too much. Can you talk to me a little bit about your family . I can mothers clothes, guys, were straightened up her life and she works and shes got a nice place for sales. And i talked to her as often as i can use thing where i came, i know i was of the household. People never thought i would amount to anything out. 20 years coming today. Im living trills that people can change if given a change, if i know im here, if given a change that one now i have no more trouble out here at all. A terry people to change that. I know ive never been able to talk to you know, how we get along as much as we can and any way i can be a support, a source of hope of something. So i get to tell them now that im in school and im doing something i know is not just taking or you know, pregnant cups off the bars like you would imagine. How does it feel when he says like, ive never been able to trade or something . I saw it in a vending machine. Its really just High Pressure and guster what have been the times that stick out in your mind or youve especially messed him around from 1st day for the long or so i didnt want anything for my birthday, but for him to walk through the door. You know, how, like little videos are the soldiers coming home. I always imagined like that itd be me like my dad getting out of prison is surprising me somewhere. Thats still a dream even now and im around people and as i have a chance to make mistakes and learn from them and grow up, you know, hes definitely not the same person. Hes a better man. Theres no way you should still be there all these years. Later we all know he didnt kill any money. The Tim Hutchison was the sheriff, went on, the enhanced was convicted, i can understand that 51 years. He has no problem with him spending 51 years behind bars. So what are you going to just say, oh, well, he was 16 and had a weapon, but he doesnt need to do just a couple of years because of his age. No, theres not. That is the act. There live people who say there should not be a felony murder charges because you shouldnt be considered a murderer if you didnt pull the trigger or felony. Murder is a way to get these people off the street and keep them off the street. And they need to be off the street. And the same goes with mister nance. He knew he was going inside the store to rom, this story. What would your response be to people who say this isnt really working and i think people up doesnt actually solve any problems. Well, for those as a, it doesnt really solve any problem by locking these juveniles up for a long period of time. And were nance and been involved in any more violent crimes. The since the Supreme Court rulings states around the country have been reconsidering life sentences for people like im here in 2021. A bill passed the tennessee States Senate that would have reduced the mandatory sentence from 51 years to 25. 00. There was opposition to it in the house, so the bill didnt move forward. The states senator john lambert voted against it. Hes an influential voice and the legislature opposing criminal justice reform. These are heinous, murder, center acts. And the unfortunate part i think we have to admit and we may not like it as a society. But there are some folks who are just born bad. And some of those people probably best that youre behind bars if its their child, if its someone in their community who is making these mistakes, they dont believe that their child was born bad. It is only people from other communities, people with different backgrounds, people that they dont have a connection with that they can sort of forget what they really know, which is the children are different. I dont see anyone surviving or 51 year life sentence can see even if you didnt for the training, even if you didnt know anything about a felony, murder, now case with you. Would you dine in prison . The we spoke with the family of joseph friday, but they declined to take part in their story. His mothers side of their old saying if you have a sore place that escaped over, dont pick out it because it will please the ive been incarcerated for 26 years. The, the society may say, throw those guys away, but i dont have to feel that way about myself. But the family they, you know, they never want to give up on you for what time i have left by to to try to be a best version of myself that i can be hello. Hey, im here. We got here by way and got back the mirror try to be as much a source of support and inspiration me from a dark place, a ton of sunlight, even from here. If i can for them. I love you. You know, let me know because, you know, when i, when my mom is seen, some of them just talk about a mile, but you dont have to come out here and get him a job. You know, thats the one mom seems at 87. Everybody lives up even from worries the ive never given up hope never when till he comes on the list that allows 13 very soon. Okay, where do you need to take a drive . You know, the way you go to the beach and not feeling known in us, but yeah, well see. Um we get a chance to get in the car unraveled me play with these kids in town with his dog or maybe hes done with the chance one day to come right in the store and be able to lead me talk to the you know, social media feels demand for a curve, youre figure a controversial surgery to help people achieve.
