The legal fight over the president s travel ban. The courts decision could come at any time, but as we heard from the president this morning, he thinks the decision san eais easy one. Any restrictions he may deem to be appropriate. Okay. So you can suspend. You can put restrictions. You can do whatever you want. This is for the security of the country. So there it is, folks. Its as plain as you can have it. I didnt and i was a good student. I understand things. I comprehend very well. Okay . Better than i think almost anybody, and i want to tell you, i listen to a bunch of stuff last night on television that was disgraceful. It was disgraceful. Because what i just read to you is what we have. It just cant be written any plainer or better. I dont ever want to call a court biassed, so i wont call it biassed. We havent had a decision yet, but courts seem to be so political. Just moments ago the president tweeted this. Big increase in traffic sbu our country from certain areas while our people are far more vulnerable as we wait for what should be an easy d. D likely short for decision from the court. Meanwhile, senators debate the nomination of Jeff Sessions as attorney general. At least one of them is linking that debate to the travel ban fight. In light of President Trumps cruel and foolish and badly executed executive order on immigrants and refugees, we need an attorney general who will be an independent voice beholden to the constitution and the american people. Not to the president. Lets get more on the impending decision on the travel ban and the potential fallout over at the white house. Our senior White House Correspondent jim accosta standing by. Our justice correspondent pamela brown is with us, and in new york our senior legal analyst jeffrey tuben. Jim, youre at the white house. In his remarks today the president spoke about how i want heed the order rolled out differently. Take us through that. Its very interesting, wolf. We did hear the president say this earlier this morning to that group of Law Enforcement officials he was addressing, and he did say this is something we have not heard before that he had recommended to his team to the department of Homeland Security that there be some sort of delay to this executive order. He said at one point during his remarks, i suggested a month, and i said what about a week . He said they said, referring to Homeland Security and Law Enforcement, they said you cant do that because then people are going to pour in before the toughness goes on. Wolf, that is diametrically opposed to what the president tweet and what some of his top officials said at the white house. Witness what he said on january 30th, wolf, in a tweet. He said if the ban were announced with a oneweek notice, the bad would rush into our country during that week. A lot of bad dudes out there. Then sean spicer echoed those remarks at a forum at George Washington university here in washington last week. What the white house has been saying almost every day when it comes to these questions about the executive order is that had we waited to put in this executive order that we would have given notice to the world and there might have been a chance for people to come into the country. Never mind the fact that a lot of Law Enforcement experts say that that would not have taken place because of the screening measures and so forth that are in place for some of these countries, but nevertheless, that is what the president is saying. It is a new wrinkle in terms of what he is trying to say to explain how the rollout of that executive order had problems according to not just democrats, but republicans, and, wolf, you did engs many, yes, that tweet that he just put out there a few moments ago. He is saying that theres a big increase in traffic into our country from certain areas while our people are far more vulnerable as we wait for the decision, the easy d, as he called it. We believe he is referring to a decision there, but, wolf, youll notice in that tweet he is talking about certain areas. At this point we dont know what areas of the world the president is referring to there. You would have to think its presumably from those areas that are affected by the travel ban that has been frozen in the courts. Were about to get tape, jim. The president has been meeting with the ceo of intel, brian. Were about to get a little bit of that meeting. The president has been meeting with a wide range of Business Leaders and others who have been invited to the white house, and, brian is just one of them. Were getting that tape in, i think, momentarily. Im going to play that tape. We have it right now, in fact. You never seen so much paper on a president s desk. Its because were negotiating lots of deals for our country, which will be tremendous. Total investment in just this factory is 7 billion, but if you take arizona, we already have two other factories in arizona. We have several tens of billions of dollars of investments and factories in arizona. Were the number one private employer in arizona. How weve been working on this factory for several years. Weve held off, actually, doing this investment until now. Was it something that president dump did or said that made you want to announce this here and now . Its really in support of the tax and regulatory policies that we see the administration pushing forward that really make it advantageous to do manufacturing in the u. S. Thank you. I presume that he is one of those tech ceos that opposes the travel ban that the president wants to see implemented. Intel signed the amicus brief. It was interesting to both of us that that was not either a question wasnt raised about it to him and nor did he mention it during his little semiadvertisement about intel. He clearly looked a little uncomfortable to me because i think he was waiting for that question. The whole scene is bizarre. I have never seen the oval office used for this kind of dog and pony show like this with the president seated and a very uncomfortable looking ceo literally selling his wears. But the unconventional nature of it, if you are a supporter of trump ace says, yeah, you know, president of action. More good news. Again, i think you see the presses with this kind of laser beam focus in his particular areas when it comes to the regulation and promoting job growth. He has his areas where he can keep, you know, jabbing and achieving successes. I think he will argue that very strongly. Thats what we saw here. This is going to be a big day. We suspect in the whole issue of the travel ban. I want to bring in pamela brown, our justice correspondent. Pamela, says if this court were to reinstate the ban and it would go into effect presumably immediately, that would potentially cause another level of chaos. Not only at International Airports here in the United States, whether jfk or lax or in atlanta or chicago, but airports around the world because once again, a lot of people would be barred from coming into the United States. Our what are you hearing about that . Are people ready for this possibility . Well, certainly. I mean, it is a possibility, wolf, and so they have to be certainly cvp is ready to reimplement the executive order and do what they did a week ago. You could certainly see a repeat of what we saw when the executive order was initially signed when people were on planes from all around the world coming to the United States and then suddenly banned, you know, when they arrived because they were from one of those seven countries listed in the travel ban. Certainly that could happen again. What was really interesting if you listen to the oral arguments yesterday not only did the d. O. J. Attorney but also the judges sort of talked about how quickly this is all happening, how fastmoving this is, and so one option could be, wolf, the ninth circuit could say, look, this is moving too fast. Were going to deny this stay from the Justice Department and have this go back to the district court. It will also be interesting to see if trumps latest comments about the fact that he wanted lag time with the executive order and he wanted to be delayed, will be brought up in this case and whether states will use that to make the point that this was harrisily done. Well have to wait and see, wolf. Allimportant issues. We should note during the course of today jeffrey tubben, President Trump, he complemented the federal judge in boston who originally ruled in favor of his proposed travel ban, but also said he was told that the boston example couldnt be used in the Appeals Court argument. Why not . Well, its not that it couldnt be used. Its just its not binding. Federal District Courts that are addressing the same issue, dont bind other courts in different jurs dicks. The court in boston is part of the First Circuit and the court in Washington State is part of the ninth circuit. They have different appeals processes. One goes to the Appeals Court in boston. The other goes to the Appeals Court in san francisco. Ultimately they all go to the Supreme Court. One reason we have a Supreme Court is that it settles disagreements among these different courts, and thats why what President Trump, i guess, was referring to is that the courts are not binding on etch auto other. Im going to have you stand by, and pamela, i want you to stand by as well in case we get that decision from the ninth Circuit Court of appeals this hour. Were awaiting that decision. Meanwhile, i want to go up to the u. S. Capitol right now. Theres a debate involving the nomination of senator Jeff Sessions to become the next attorney general of the United States. A vote is expected later today. These live pictures coming in from the senate floor right now. The debate continues. Last night the debate took a very dramatic turn. Democratic senator Elizabeth Warren was rebuked for reading past statements critical of senator sessions, including a letter from Coretta Scott king. Mr. President they are mr. President. The majority leader. The senator has impugned the motives and conduct of our colleague of alabama as warned by the chair. Mr. President , i am surprised that the words of Coretta Scott king are not suitable for debate in the United States senate. I ask leave of the senate to continue my remarks. Is there objection . Object. I appealed the ruling objection is heard. The senator will take her seat. Our senior congressional reporter manu raju on capitol hill. Very dramatic stuff. You just had a chance to speak with senator warren. Is she feeling emboldened by the rebuke by the majority leader . Whats she feeling about that today . Absolutely, wolf. She is defending her move saying that even though the senate did find her in violation of the rules of decorum, she believes she was just trying to present the facts as she whether or not he would fairly enforce laws involving that could hurt and disenfranchise africanamericans. I asked her questions about why she carried on with this line of attack on the floor. Even as she was warned last night that this could break the senate rules. She strongly defended her decision and said that the reason why she did it was to prosecute the case against Jeff Sessions. Take a listen. Do you really believe what that letter says that she that he could unfairly intimidate and disenfranchise elderly black voters . Yes. I believe the facts show that is exactly what he did. In fact you think he would do that as attorney general . Let me read to you what she says he did. Senator, do you think he would do that as attorney general . She says he accomplished, mr. Sessions accomplished, with a federal prosecution what the local sheriffs accomplished 20 years ago with clubs and cattle prods. Is this kind of rhetoric back and forth really what voters are looking for right now . To fight donald trump tooth and nail . I dont think voters are asking us to ignore facts. I dont think voters are asking us to say, you know, were just going to ignore what this man did to black citizens. Because its not only with black citizens. The speech also talked about what he has done with immigrants, with women. The real question for an attorney general of the United States is whether or not he can be trusted in those hours when you cant review what he does. Can he be trusted to do two things. To stand up strongly on behalf of everyone. Not just those he agrees with, but everyone. Secondly, does he have the intestinal fortitude to stand up to the president of the United States when the president issues an illegal and unconstitutional order . Now, wolf, she also acknowledged that the democrats really do not have the votes to stop these trump nominees, but she said that she needs to the democrats need to do everything they can to shine a spotlight on some of the concerns that they have. Interestingly, i asked her about her support actually for ben carson to be housing and urban developments secretary. She did not want to discuss that because thats something that actually has gotten her into some hot water among some of her supporters. Shes also been skrit sized by some of the republicans who believe shes using this to help catapult her to the front of the line for 2020. I asked her is that something youre open to or thinking about, 2020 . She said, im open to doing my job. Strongly defending her move. Wolf, the fact that she was found in violation of this rule exceptionally rare. Orrin hatch, the longtime senator of the senate, long of time senator from utah told me he cannot remember a single time that this has happened in the past, so clearly it just shows how emotions are running very, very high in the early days of the trump administration, woflg. Right now, though, i want to take you to the senate floor. The debate over the attorney general nominee, senator Jeff Sessions, now going on for roughly 24 hours. On the senate floor, the biggest moment came last night when republicans blocked senator Elizabeth Warren from reading a highly critical letter on sessions written by Coretta Scott king. Since then at least four senators have taken to the floor to read kings words starting with senator jeff merkley of oregon. And i quote, i do not believe Jefferson Sessions possesses the recollect quiz it judgment, competence, and sensitivity to the rights guaranteed by the federal civil rights laws to qualify for appointment to the Federal District court. Senator merkley is joining us. Thank you for joining us. Great to be with you, wolf. Why was senator Elizabeth Warren shut down prevented from speaking during the course of this debate, and you werent . A group of basically white republican legislators shut down a woman, elizabeth, who was presenting information relevant to this nomination from a civil rights icon, Coretta Scott king. Testimony that was already in the Senate Record because she gave this testimony to the Senate Judiciary committee in 1986. She was shut down because it is up to the chair to rule as to whether conduct is appropriate in terms of criticism of fellow senators, and my colleagues decided interpret this in Jeff Sessions role as a senator rather than his role as a nominee. So they allowed you to go ahead and read the exact words from that letter that she was prevented from reading . Is that right . I read 90 of the letter, but then characterized the rest of it and gave her final closing summation so that i would be slightly different spot than elizabeths was, but, yes, basically the answer to that is yes. The Senate Majority leader Mitch Mcconnells statement on senator warren last night included the words nevertheless, she persisted, and thats becoming a rallying cry for warren supporters. Hillary clinton, for example, tweeted about that among so many others. You and three of the other supporters, once again, this is thehill Hillary Rodham clinton tweet. She was warned. She was given an explanation. Nevertheless, she persisted. Thats the quote from senator mcconnell that Hillary Clinton tweeted herself. This whole notion, though, is that senator mcconnells action shutting her down has backfired. Shes getting a whole lot more publicity on this issue right now than she ever would have received if people would have just been watching that floor debate on cspan, for example, but heres the question. Senator sessions, he is about to be confirmed from the u. S. Senate, and there isnt much of anything else you can do about that. Well, thats probably right, but we have to fight. In the words of mcconnell, we must persist, and elizabeth did a great job of that last night. My caucus exchange speaking through the night to make the point, that letter, by the way, what that was about was an abuse have power by Jeff Sessions when he was in the position to do so to launch investigations they are ability to vote to make a difference, and that is absolutely a trend, a theme that continues in the Republican Party of voter suppression. They want to prevent africanamericans from voting. They want to prevent hispanicamericans from voting. They want nrch anyone to vote against their base or not to vote except their base, and this really is an assault on you are on constitution because our nation is founded of voter empowerment, not voter suppression, and that is why this is very relevant to this nomination, because we have a vision of justice to all, not government by and for the most powerful. Of course, the republicans deny that. They say they simply want stricter voter id to be sure theres no fraud going on at the polling booth. Theres a whole conversation about that. I do want to ask you about the Supreme Court nominee, neil gorsuch. He is on capitol hill today. You describe gorsuch as being on the far extreme right. Are you at least sitting down and talking to him . I am open to the first thing im going to ask him is his opinion about the theft of the Supreme Court seat from the Obama Administration to the trump administration. This is the fist time in our history that the Senate Majority has stolen a senate seat, put in a time capsule, delivered it to the next president , and to do so in order to bias the Supreme Court. This really is very destructive to the sbeg of the court and its very destructive to our we the people vision of government because this was done by republicans in order to sustain the flow of dark money that has put them in power in the senate. Dark money that is corrupting our elections, corrupting our democratic republic. Once again here, let me point out what the republicans say this nomination was introduced in the final year of a president s and in a final yeefr a presidency. That was different than the first year of a presidency as a result they withheld they didnt evenment to meet with the obama Supreme Court nominee and there certainly was not any voting that was going on. Let me ask you about this Appeals Court panel. We could expect this ruling literally any time in the course of today, whether or not to reinstate President Trumps travel ban. Do democrats have a plan in place if the court rules in favor of the president and lifts the travel ban suspension. We will push that forward and persist and fight for a vegs of america that is about religious nondiscrimination, religious freedom, and well kwaer the fight in every manner we can. Now all of a sudden President Trump is saying, you know what, we might not be able to replace obama care until next year. How frustrated are you by talk like that . It could take a lot longer not only to repeal, but to replace obama care. I think it would be a big mistake to wait. I think we should wait on replacement the same day we vote on row peel. Weve had six years to complain about obama care. Weve got a lot of good ideas. Ive brought it together a consensus package of things that every republican agrees with. Ive put it in one package in a obama care replace am act, and we plan on introducing it the same day. We want to vote the same day. What i would say is that when you vote on reforms, when you vote on replacement, it may be that the effects of the legislation take a while to create new opportunities in the marketplace. It will take a while for the replacement bill to have an affect, but we actually should not wait a year to introduce a replacement bill. That is a terrible, terrible idea. Have you had this conversation directly with the president . Well, yeah. Last time we talked he said he was in favor of replacing at the same time. Now, there are certain things we cant guarantee. We cant guarantee when the effects occur. We also cant guarantee that any democrats will be willing to work with us. Were actually actively looking for democrats to work with us on maybe Health Insurance better for the country, making health care better. Were not having a lot of luck. Theres a lot of angry people around here that cant get over the election. I am hopeful the democrats will, you know, calm it down to a lower level and that they will work with us. Absolutely if i talked to the president again and when i talk to my leadership in the senate and leadership in the house, i tell them its absolutely imperative we vote the same day on replacement the and the replacement should not be another Government Program and shouldnt be obama care light. Lets talk about another key issue. The senate votes later today on the nomination of senator Jeff Sessions to become the attorney general. Last night senator Elizabeth Warren was rebuked, banned from the debate after criticizing senator sessions. Democrats say republicans miscalculated. Listen to democratic jim hines. As a political matter, if Mitch Mcconnell wanted to further activate an already activated democratic activist wing, boy did ever do that last night. Do you believe, senator, and i know you are a strong believer in free speech, that senator warren should have been rebuked and shut down by the majority leader . Well, you know, i think a lot of people on the other side of the aisle are very still very unhappy about losing the election, and i think their frustration is boiling over into ad hominum. Basically character assassination, and i dont think its fair to Jeff Sessions, you know, to say that he is against voting rights. I have seen the pictures of him marching in selma with john lewis in favor of voting rights. For someone to mischaracterize who he is, to attack his character, to assassinate his character, yeah, i dont think that has a place on the senate floor. If you look back through you know, i have talked for 13 hours at a time without condemning anybody when i talk about president obama, the previous president , i did it with respect and so i think we can have respect the way we treat each other. We can have differences of opinion, but i think a lot of this is about people on the other side of the aisle. Theyre just not come to grips with the fact that they lost the election, and theyre very unhappy and so theyre lashing out at everyone, and really it just isnt fair. I mean, republicans as much as anyone, we do believe in voting rights. I do believe in voting rights, and its just not fair to assassinate someones character and Say Something thats not true. But simply reading from a letter from Coretta Scott king, a letter that was written in the 1980s when he was then himself being considered for a federal judgeship. Was that inappropriate from your perspective . You can say anything you want when you are not on the floor. On the floor we have special rules. It isnt about freedom of speech or first amendment. Its about decorum, and we ask people to be polite to each other on the floor. Most of the time youre not supposed to refer to anybody by name on the floor. Youre typically not supposed to mention republican, democrat, or individuals name on the floor. Its this way of trying to allow us to reach compromise by not making things so acrimonious that were at each others throat all the time. The rules of the senate allow you to come back and you have privilege time to respond to that as well. I dont know. I think theres a way we could debate this. I did hear the letter. I was sitting there this morning and heard the letter read. It is simply someones opinion from event that is happened a long time ago, and, you know, its part of the congressional record. I think we can differ about it, but i think when we present things like this, we have to be aware that people take it personally. If you say that youre against people or that you are a racist or that you are against voting rights, that is a character assassination, and i think unfair. Lets talk about Foreign Policy for a moment. Do you remember the Foreign Relations committee . Were told that Elliott Abrams is now a leading candidate to become deputy secretary of state, the number two position under rex tillerson. He has met with the new secretary of state, were told. Youre a member of the committee, but you have come out strongly against abrams. Why . Well, i think President Trump should pick somebody who agrees with President Trump. One of his loudest critics throughout the campaign was Elliott Abrams. When he talked about when President Trump said nation building abroad, we dont have the money to do it. We need to build our nation here at home. I really support that. I support President Trumps vision for nation building at home and not nation building abroad. When Elliott Abrams was asked about this, he said absolutely the president is wrong. Elliott abrams went on further to say that the chair that washington and lincoln sat in, that trump wasnt fit to sit in it. It was very, very personal with regards. He was a never trumper. Even in the end when donald trump was a nominee, Elliott Abrams was still a never trumper, and i just dont see a never trumper, maybe they should never be in the state department. I think particularly since they dont agree with President Trumps vision of nation building is a mistake, regime change is a mistake, iraq war was a mistake, Elliott Abrams was one of the chief architects of the iraq war. Also, he was convicted of lying to congress. We have to have people that will listen and understand that they work for the people and that they work under the direction of the congress. No war is to be initiated without the approval of congress. Thats in the constitution. Yet, Elliott Abrams was involved in covert wars, supplying weapons, taking money from the sultan of brunei, buying weapons and selling weapons in iran, and then taking the proceeds of that and giving it to authoritarians in nicaragua.
