The Foreign Policy standoff between the president and congress n. A move that blindsided the white house, speaker of the house john boehner inviting the israeli Prime Minister Benjamin Netanyahu, to stand before congress and push for new sanctions against iran. He will speak in march as lawmakers on both sides are pushing for fresh penalties if theres no deal soon to prevent a nucleararmed iran, a measure the president promises to veto. Speaker boehner says his invite in no way breaches protocol. I did not consult with the white house. The congress can make this decision on its own. I dont believe im poking anyone in the eye. There is a serious threat that exists in the world. And the president last night kind of papered over it. Well last night referring to the president s state of the Union Address. But a white house that was caught off guard appears to see this very differently. Now, traveling on air force one with the president , press secretary josh earnest saying quote this particular event seems to be a departure from that protocol. But, again the president hasp spent more time and on has spent more time and on more occasions talked to Prime Minister netanyahu than any other world leader. Okay, judge, i want to go to you first on this. This appears to be the biggest clash that weve seen between congress and the white house on the middle east. Of course, the president talking about sanctions against iran saying im going to veto anything that imposes sanctions. If you look there actually is some democratic support. I believe 12 democrats are joining republicans and following mr. Boehners lead saying listen, we have to do manager. Weve got to put together some legislation that could impose sanctions on iran and, judge, if they get those 12 democrats, they may be able to override a president ial veto. So this could be a really big deal. And it should be a really big deal, because this is not partisan politics. If iran gets a Nuclear Weapon what happened in paris wouldnt have been a few guys with machine guns killing a handful, it could have been a dirty bomb going off and killing hundreds of thousands of people. That is a total game changer and netanyahu knows it. I think this is exactly the type of situation where democrats and republicans really have to put everything aside and override a president ial veto. The argument that this is a snub against the white house, a violation of protocol, seriously . I mean, the way the white house has treated netanyahu in the past . Yeah. President obama, because he was angry that he wasnt making concessions on settlements, left netanyahu with staff and went to dinner with his wife . Thats right. The white house has snubbed netanyahu on a number of occasions even when he was in israel, he snubbed visiting the knesset, so now the white house is saying theyre violating protocol. How about how the president treats congress . I always like to look back at history. By the way, the joint session speech is set for february 1 119th, just so we put it out there 11th. Nancy pelosi went to meet with president basharal as sat despite Bush Administration objections. Diplomatic registrations had broken down relations had broken down in the 1990s and president bush rejected it saying thats not whats going to work. Why was it okay then but not okay now . I use history as the benchmark to inform us, why is it not okay . Thats the reason why the public hates politics because it always comes down to a matter of whos ox is being gored. Thats right. Look, if you look at netanyahu standing up there, if you dont cooperate, look whose side were on . Well there hasnt been president ial leadership as it relates to to our relationship with israel, so youre seeing boehner and Congress Step this to fill the void in a very important area with respect to our national security, Foreign Policy and that of israel. We have really faltered as a country to really embrace them because of the direction of this leadership and their political ideology. I think this is crucial. He did not violate any constitutional laws. Im happy to see this kind of stepping up to let the president know you will no longer act unilaterally. We represent the people of this great country, and this is the direction we need to go in. Its strategically smart on his part. Even very conservative republicans like Trey Trey Gowdy matt salmon in arizona their facebook pages and twitter and phone lines blew up when they voted for boehner because the base wasnt sure he would be tough enough against obama. I think this shows that hes tough, i think it represents the will of the members of the house. Ive talked to some of them, and they are mad about him coming into, you know, being welcomed into the well of the house and giving a campaign speech. Rachel your husband is a member of the house, hes a congressman. Quickly, do you sense this is a new tone that boehners going to take, tough talk with the white house . I think hes going to get positive feedback, and thats going to encourage him to keep it up. Well, if his weekly address was any indication he says if the president expects us to capitulate on this quoteunquote, hell no. The accusations that the super bowlbound patriots broke the rules by using underinflated footballs. Some players say balls with less area give them a better grip. But if you knew the calorie counts, i have an app that tells me the calorie count of all the stuff that i eat, and i refer to it when i feel guilty about how ive been eating and its really depressing when you realize the stuff you like to eat has more calories than you should eat in a day. Former secretary of state Hillary Clinton is ramping up a possible 2016 campaign but at a paid speech last night she dodged a lot of questions on iran are iran sanctions. She said she takes the same position as president obama. She wouldnt say what she would do differently when it comes to working with congress, and on the controversial Keystone Pipeline she only offered this you wont get me to talk about keystone because i have steadily made clear that im not going to express an opinion. If you work for the city of boston and you dont like the city bidding to host the 2024 olympics you better zip it. Of thats because the citys mayor, martin walsh just signed a deal with the u. S. Olympic committee that bans city workers from bad mouthing the olympics. For his part, the mayor says no City Employee will ever be punished if they speak out against the beantown bid. Nevertheless, the decree is not sitting well with civil libertarians who are calling it unconstitutional. Are they right . Yes, probably they are. The reason is, you know the First Amendment protects you against government action. If you criticize something you cant get arrested for it by the government. But it doesnt protect you against private action. You could get fired by your employer. But what happens when the government is your employer . Thats where it starts getting really dicey, and the Supreme Court hasnt gone so far as to say youre protected, you know when youre an employee for the government, you can say whatever you want. They dont say that. But they look at what the speech is. If the speech is something they consider to be of public concern, then you have First Amendment protections, and they apply a balancing test where they say, okay were balancing your rights to speak about something that is a public concern against the governments right to keep an efficient workplace as an employer. And they make a determination whether or not it violates that. This being this is not something thats going to be enforced. Well, hes already said hes not going to the mayor made it clear. So is that a breach of contract since he said he would . Can the olympics just say no . The Olympic Committee requires every city to tell their employees this, dont criticize the olympics. Rachel im curious though what if your objection is we dont have enough Parking Spaces . What if theres a legitimate reason why you wouldnt want to have it . Or could there be a slippery slope, judge . Because he put that in you cant say anything bad about the mayor . No. What i was saying was, yes, this would probably be unconstitutional okay. Because the olympics would be a matter of public concern. So the employee would have a right to criticize them, and thats probably why hes saying were not enforcing it. This is something that would not hold up if he tried to enforce it. Why is he putting it in there . Hes required to by the Olympic Committee. Bottom line is if you have a meeting in the ladies room and you want to talk about, whoa, this is going to be horrendous theres going to be no talking at the mall if the olympics come, you could i hate to tell you, the worst thing to do is tell people of boston they cant talk about it [laughter] ill show you although if theyre city workers and theyre complaining about having to do additional work because of the olympics, im wondering if theyre good employees to begin with. Theyre probably the ones who are taking those extra bathroom breaks [laughter] good of you to point that out because thats where it starts becoming hairy. If somebodys complaining about the extra hours they might get fired, and it might get upheld. Because it maybe does point to a laziness issue. Well, for the record, we love the olympics. If we didnt, i guess we wouldnt say it . I dont know. President obama is standing by his promise to close guantanamo bay. He mentioned it during his state of the Union Address tuesday. Many of the remaining prisoners are considered too dangerous to release. We know that. So what should the u. S. Do with those people . And target igniting a debate whether overweight people should be a protected class after the retailer moved to sell plus sizes of new clothing online only. Keep your big self a secret, i guess . Hmm. A move by target is sparking debate over civil rights and overweight people. The retail chain recently announcing one of the clothing lines it will carry will only offer plus sizes online. Critics say it treats overweight people like second class customers. Target i saying, quote were offering plus sizes on target. Com because target. Com gives us an opportunity to try different things. It affords us the opportunity to be flexible in terms of air assortment and keep anything the mind the last time we offered plus sizes in a de seen it didnt work. Judge, theres been years of discussion about that. Where do you see that idea going in the law, and should it happen with Something Like this . I think were pretty much there. Yeah. I mean michigan is the only state that has protection against overbought people being discriminated against in the workplace, but there are several cities across the country that have ordnances and laws city wide about that. But it really doesnt make that much of a difference because i mean im against discriminating against anybody and overweight people very often have insecurity issues and problems, you know they suffer a lot from trying to deal with their weight. The last thing you need to pile on top of that is losing your job because your boss doesnt want to hire an overweight person. That being said were at a point now where the ada was expanded effective i think, 2009, the adaaa expanded the definition of disabled people to the point where it pretty much doesnt make a difference. I mean, its so much easier to be declared disabled now that if you have high blood pressure, something that a lot of overweight people have, you can be considered disabled. If you have, you know, diabetes, which a lot of overweight people have, you can be considered disabled. So you have and if an employer considers you impaired in some way because of your weight then you satisfy the requirements of the adaa so there are current protections under the law. Theyre pretty much there. Theyre pretty much there. Now, the reality is also that with the United States being headed towards the highest number of obese individuals that weve ever had this our history, going to get to the point where everybody that lives in this country that was kind of my question are you doing anybody a favor by doing this when you have such huge rates of obesity . Yeah. And youre not really protected. What it reminds me of is theres a protection that when judges are picking a jury, theyre prohibited from doing it based on a racial right. Reason okay . Well, that has been expanded by courts over and over again to where you couldnt do it based on somebody being africanamerican, you couldnt do it based on them being a female, based on religion, and then eventually they said white is a protected class. So then whats the protection . [laughter] sooner or later, overweight is no longer going to be protected. Judge, this is whether or not, this isnt whether or not target should hire plussized people, its should they be able or could they be able to sell whatever they want to sell. And so theyre stay saying look, were going to sell it, were just going to sell it online. I actually think they should be allowed to sell whatever they want. Lawsuits of people coming in going i cant find, you know my plus size yoga pants im suing. Yeah. I think they should be able to sell whatever they want online the question i was asked is should overweight people be considered a protected class. Should they be able to sell the clothes online . Of course, thats a business decision. But im surprised because with so many people being overweight im surprised that they dont want to stock their stores with it. They said they tried to collaborate, and it didnt work. Thats a business decision. Well, thats their right. They dont have an obligation to provide all the sideses. How many times you go to the score, your size is gone. Go online, go to another store. Its hard to shop online. You buy eight different things, and you have to send it back. Again, i dont understand. Theres this huge overweight population i know. You could think why would they do that . If a store does not cater to you, that does not mean youre being discriminated against. Thats right. That means you discriminate against them and move on thats right. Thats what im saying. Keep the government out of it but i think overweight people should be mad.
