Attorney general just decided not to appeal a case to the Supreme Court challenging their good reasons statute which was said if you want to carry a gun in public you need to show the police commissioner that you have a good reason to do so right so all across the country there are laws on the books that require people to show that they have a reason they have a need to exercise their right and I m sorry but I refuse to even engage in that kind of argumentation because this isn t the Bill of needs it s the Bill of Rights and the minute that you even accept that line of logic you surrender as a right and it becomes something that you just need to prove you need well I absolutely agree with you but the the argument that we hear thrown about in regards to that and I played a clip earlier of Jimmy Kimmel who is throwing my name Jimi into the mud every day now it seems and that is he is making the argument this is a public safety issue and therefore it s a different standard because guns are different than any other right that we re talking about because My Words won t hurt you but sticks and stones can break your bones. And when Congress passed that the Democratic senators who pushed that through we re talking about there the whole messaging was preventive services for women and they were very careful not to talk about contraceptives they were talking about mammograms they were talking about cervical cancer there are about all these different issues and they studiously avoided the word contraception and the reason why is clear if you look back at over Congress over the decades dozens and dozens of times people have introduced legislation to have a contraception mandate and Congress has always said no and so that s the baseline is the American people through their elected representatives has said No Ok so then this goes over to h.h.s. Who gets to define. What preventative services going to be covered under this general law that Congress passed they put together a committee. Full of people from they were all in Planned Parenthood and they produced a report and that report cooked up some really some research which said that it would help poor people it would help poor women if they had more access to contraceptives and they use that report in order to justify forcing employers to give fully employed full time employed women contraceptives for free so there s no disconnect there there s a huge disconnect there but that s just sort of the part of the back story this whole thing was really sure quarantine. In a way that was really. Odd from the very beginning so this got passed in 2011 was passed from the very beginning without any sort of an exemption for any religious groups and this was controversy even within the Obama administration Joe Biden and then his chief of staff at the time Bill Daley a Catholic from Chicago argued with him in the web and in the Oval Office do not take on the Catholic bishops don t do this this is the wrong move but he was pushed by. Valerie Jarrett Jarrett and some other people to go ahead and do that since it was originally came through the 1st version had no exemption at all and then after a while he backtracked a little and says Ok too will be an exemption but only for churches that don t serve non Christians so if you serve people outside your faith you don t get it felt sort of missionary groups all sorts of other charity groups didn t get that exemption and they fought over that and then they took another step back and they finally said Ok all churches are going to be exempt and that fixed part of the problem but then what happened is there s this whole other category of including the Little Sisters of the poor and cooed ing Catholic Charities all these other groups that are religious but they re not defined as churches. And the Obama administration gave them what it called an accommodation and the accommodation says you still have to have it in your health plan you still have to tell your employees that they re getting it through your coverage as a religious organization but we re going to do some accounting work behind the scenes and you re not going to end up actually having to pay for it and they said that s what you get that should be good enough and religious organizations across the country said no more than a 100 lawsuits and that has been going on for years and years and years and it s only now with this regulation that the trumpet ministration under its h.h.s. Is finally saying that was illegal that was not what our laws in the Constitution demand and we re going to do better and so now let s turn to what the trumpet ministration is doing so after years of the Obama administration providing what what you and I would consider to be an affront to religious liberty the trumpet ministration is very much broadening these exemptions to what extent so the $170.00 pages that came out on Friday it goes into great detail over the history of. This legal dispute and explained in an extreme detail why h.h.s. In the Trump administrator is taking the position that it did why I believe that what Obama did was illegal and then at the end of the day they said here s what we re doing the exemption that we finally gave the churches it suggests way back years ago it s a test is now extending that same complete exemption to any religious group that wants. And so it s not carving up churches and other groups and putting them in a tiered system it s saying if you re a religious group you get it and that includes the churches It includes religious nonprofit It also includes religious for profit organizations like Hobby Lobby that was the one who went all the way to the Supreme Court and so if the trumpet ministration also recognizes that you don t sacrifice your conscience in your religious principles when you decide to go into business that those things are not incompatible and so if you re religious and your employer you get this exemption Now let me let me ask you that question just just to clarify in terms of religious How do you determine if it s if you re religious if it is it just if you declare I m religious therefore I don t want to follow this is that the way that that is determined. More or less in the context of a for profit there s a little bit more rules to it and so when the and under the previous version of this and this is not spelled out in quite the same detail but I think the same rules are generally going to going to hold here if you re closely held company. And if you have a majority of your ownership. Professes a religious faith and has a religious belief that this is immoral then you get it it s neither radically could extend to even a publicly held company but the idea that a public company could show that. More than 50 percent of the people who hold ownership in a stock that a majority of shares are held by people who share religious beliefs that s almost in the if I can even imagine what that would be for i.b.m. Or Microsoft to try to make a showing like that and so it s theoretically possible but this is really only going to be closely held organizations one thing that s interesting here Jimmy is while there s a lot of outrage even in New York Times recognizes that the effect of this is going to be very small chip in the New York Times article that came out on Thursday before the regulations came out you re kind of broke the news they said that they thought that this mandate has expanded contraceptive access to 55000000 women and they said hundreds of thousands of women may be affected by this new exemption. So they re very small number compared to the whole so the idea of this is opening up a new war on women the idea is going to unravel all sorts of rights is a really narrow thing that is going to deal with really Doe s employers that have already stepped forward identified themselves and said look we have a problem anyone who had a problem should have already stepped forward because court after awhile started giving out injunction well really easily and so it would end and so we think we know the world who s going to be affected by this and it s not that big Well it s interesting because that s not the sense from their editorial board air if in the end that is thing they for example average of this paragraph 2nd to last paragraph from their editorial yesterday the Trump administration says with no evidence whatsoever that it s new rules will have no effect on quote Over 99.9 percent of the $165000000.00 women in the United States it further argues that low income women will still be able to get subsidized or free contraception through community health programs and government health programs left unsaid is that the administration has made no secret of its desire to substantially cut government spending on programs like these several public interest groups like the Center for Reproductive Rights the National Women s Law Center and the American Civil Liberties Union say they plan to challenge the Trump rules in court and he thoughts on that and in particular the challenge that is going to come from some of these legal organizations. Sure yeah there 1st of all you know the New York Times editorial board needs to talk to their news department get their facts straight this is not going to affect very many women across the country but yes 2 lawsuits were already filed yesterday by the a.c.l.u. And they filed them predictably in San Francisco and in Massachusetts where they think they can get some very favorable judges. They had a broad array of claims that they set out in their complaint I think the 2 most important ones is one is claiming that it violates the establishment clause to honor religious liberty that s a loser and the other one is saying that it s sex discrimination to honor the convictions of religious groups and that s also a loser there have been a lot of lawsuits decades that have been trying to create a contraception mandate through Title 7 which is the employment discrimination law that says no sex discrimination employment and courts have said no on that and I think the same thing s going to hold here so there s going to be a lot of noise and you never know what a liberal judge in San Francisco or Massachusetts is going to do but ultimately I think those those legal claims are losers now I ve got about a minute in this segment I m just wondering where where the this position is that you think you think the president comes from in terms of the merits I mean do you think that he s really got the Constitution and righteousness if you will on his side. I do I Do we have an incredible history as Americans of honoring religious liberty going back to Washington and Lincoln. To presidents and military leaders when our nation with on the line said that they would exempt people from military service even at these moments where a country was on the line even when we needed soldiers so badly they said We need soldiers but not not as much as we need religious liberty and they let people go that s an incredible heritage that we have that says that even when the state s interests are really really high we re going to respect religious liberty and President Trump executive order he s going to religious liberty follows that tradition and I am very grateful that we have a president and an h.h.s. And us and we pleasure to be with you thanks for joining us on the phones in the next hour 303696971 we re talking with attorney Eric Nif and he was with the Becket Fund for some time also had been in the Department of Justice s Civil Rights Division and he s been litigating against the Department of Health and Human Services contraception mandate sense 2011 fighting for religious liberty for many years now represents Dr James Dobson also the Catholic benefits Association a group of over 700 Catholic employers and we ve been talking about the contraceptive mandate and president trumps expansion of exemptions from the contraceptive mandate . That is in so many ways I would say unconstitutional violation of religious liberty but Eric what we get so often whether it s this and we re already getting it here that this is an assault on birth control mandate under the guise of religious liberty we are getting whether it s masterpiece cakes and and the different companies that don t want to serve gay weddings because of their religious beliefs and so forth under the guise of religious liberty you get this argument that religious liberty is just a smokescreen or a mask for some type of bigotry where does the left get this idea and why is it wrong where is their flaw why is it in fact truly religious liberty when we re talking about these issues that is in play well I think 1st of all the law that s at issue with the contraception mandate in a lot of these lawsuits that law is called the Religious Freedom Restoration Act And the reason I mention it is that it was passed in 1903 its sponsors in the house with Chuck Schumer in the Senate it was Ted Kennedy it sailed through Congress both houses almost unanimously and was signed into law by President Clinton and this joyous rocket signing ceremony at the White House this was an absolute no brainer not that long ago and it s incredible to see how quickly the left has flipped on religious liberty and the cynicism with which they speak of this issue. It is really astounding. But I think if there s something here that sort of shows the insincerity in that argument Jimmy the law does not protect religious liberty where it s insincere So the Obama in these 100 lawsuits with hundreds and hundreds of employers and any one of those lawsuits if the Obama administration really thought that this was a scam that religious groups were doing because they hated women they could have made that argument any single one of those lawsuits it never happens it never happened this religious groups are insincere the idea that Catholic bishops of the Little Sisters of the poor the Hobby Lobby that what they really want to do is just oppress women that s the story you hear an op ed but it s not what these groups argue in courts and that s because they know it s a whole bunch of junk and so yes if it was insincere there would not be religious liberty protection and they like to talk about that in the fundraisers they send out to their donors and they like to talk about that in their stump speeches but when it comes down to it they know they can t prove it they know it s not true but that s just the way we are that s where we are right now. And it s just maddening at times when you hear it constantly but that s a great point that it they re not arguing it in the court of law and it s because they cannot prove it and fortunately we are at a time with you Aaron if in our guest here on the Jimmy saying in burger shell but it has been a real pleasure very insightful thanks for joining us and breaking it all down for us you re welcome good to talk to you great to talk with you as well again and attorney Eric Neff and here on News Talk 710 k.
