Abcs geo benitez has given dealerships the road test for our series nightline investigates. Reporter heading into this new jersey car dealership undercough tore buy a new truck. One of the biggest dealers. Reporter but not just any truck. This one. Which we know is under a safety recall for a potentially dangerous defect. Just this last year there were nearly 64 million safety recalls, ranging from powers to power steel defects to air bags. By law the dealership is obligated to fix these potentially dangerous defects before a new car is sold. We want to see if this dealer will fix this truck before they sell it to us. Thats its a new car, thats why i figured theres no recalls. I did not physically check to see. Is that something you think you might change now . People arent expected to sort of know when you get a brandnew car, its always supposed to have all the recalls taken care of. I made a mistake. The dealer admitted that they made a mistake telling abc news we have realized that our failure was tied exclusively to human error. He added that the dealership will now be running vin numbers to check for recalls before vehicles leave the lot. But its not only this dealership. Weve uncovered hundreds of new cars from multiple manufacturers that were sold with unfixed safety recalls in over 40 states. Incredibly, the national highway Traffic Safety administration, ntsa headquartered here in the nations capital, only fined two dealerships in 2014. I think this is very serious. I think that americans have a right to know that when they buy a brandnew car, the car has no defects in it. Reporter senator ed markey sits on the Senate Subcommittee on consumer protection. We found hundreds and hundreds of new cars that have recalls on them, and they were sold. And thats wrong. You have to assume that when theres a brandnew car with that new car smell in it that there are no defects. Ntsa has 51 people on that enforcement team. We have a couple of producers. Why cant ntsa do it . Ntsa should have done that work. It shouldnt take an investigation by abc to find this problem. Ntsa is now put on notice that its job is to be the cop on the beat. Reporter ntsa declined an oncamera interview but defended their enforcement efforts in light of budget restraints.
