what's especially interesting as we talk about this nervy and pivotal question an presidential immunity, a different group of judges in the d.c. circuit all right weighed in on this and taken a decision against trumps. days, weeks, after election day 2020, he was acting in his personal capacity. there's a litigation against trump that eessentially suing him for inciting the riot and appellate on that circuit site sided with lit against against trump and noticeably reached that decision specifically cited the fact that all the way back, back in late 2020, early 2021, donald trump was filing these lawsuits and explicitly saying that he was acting in his personal capacity as a candidate. the very piece of evidence that we wrote about in this piece has

and you could see concurrence from judge henderson, if they were unanimously could affect the prospects for a remand, and remand might entail a subsequent round of appeals under the remanded standard by trump and a little bit more delay. it also could affect whether the supreme court takes review. so that lower level, there was some drama. i think people were basically not confident about the way in which the panel, the panel will reject his claim. they will do it quickly. the exact rationale is a little bit uncertain, i'd say. >> i just be clear on the definition of a rebound, remained is when an appellate sends it back down one level and they say we are going to put -- we want you to reassess this issue, but with these sort of parameters. and you heard jack smith attorney say, no, no, no, that's a terrible idea, let's not open that can of worms. like, you guys should affirm, and on and let's get on with the trial. if he's got appealed, he makes them after judgment, just like everyone else.

argument, but they made it with a very broad overreaching notion that the president is absolutely immune because he was the president and as jack smith pointed out in his filings, not only is there no, you know, jurisprudence precedent for that, but from a common sense standpoint, that really creates a very dangerous situation. i mean, anytime you grant immunity in any sense to people, even when prosecutors give immunity, it's a gamble because what you're doing is creating an incentive for people to engage in bad behavior because you're giving them a pass on the behavior. it doesn't make sense from a constitutional standpoint, doesn't make sense from a legal precedent standpoint and it doesn't make any sense from a policy or common sense standpoint. >> all right. so jack smith tried to get the supreme court to answer this question, they said, no, got to go through the appellate level first but you expect that ultimately this will get back to the supreme court and that's where we will get the answer? >> yeah, that decision by the court is kind of a win-win.

these circumstances. so, the appellate court could simply tell her to go back and determine whether or not these actions can actually do more. and so, that will run out the clock. it could be the case that they issue a decision here and then it goes on bunk, and the entire d.c. circuit has to hear it. that will put time on the clock, and then it goes to the supreme court, which will add more time to the clock. basically, just the fact that we are in this intermediate appellate face gives trump a tactical advantage of making sure this case never gets to the trial in march that has been in plain. >> and that answer, you anticipated my follow-up question, which is for the non lawyers out there. what's gonna happen in washington is before a three judge panel. and then, depending on how they rule, there's a possibility that whatever they decide, it's appealed to the overall appeals court, which is what you used, the phrase on bunk. you know, to go to the full court of appeals. let's turn our attention to new
