The Mumbai Court while granting bail to Aachit Kumar in the case said merely on WhatsApp chats, it cannot be established that he had supplied drugs to co-accused Aryan Khan, son Bollywood superstar Shahrukh Khan and Arbaaz Merchant.
The court also raised questions on the veracity of NCB's panchnama records, saying they were fabricated and seemed suspicious
The court, while granting bail to four others who were linked to the event management company Caneplus Trading Pvt Ltd which had organised live shows on the Cordelia cruise, noted that there was nothing placed on record by the NCB to show they had financed or harboured any offenders on the ship.
A special NDPS court ruled that, aside from WhatsApp chats, there is no other evidence that Aachit Kumar supplied drugs to Aryan Khan.
The NCB had vehemently opposed the bail plea of Aachit Kumar. His lawyer has argued he used to play online poker with Aryan Khan and their WhatsApp conversations were not about drugs.
