ന്യൂഡൽഹി: മുൻ ധനമന്ത്രി കെ.എം. മാണിയുടെ ബജറ്റവതരണത്തിനിടെ അന്നത്തെ പ്രതിപക്ഷ എം.എൽ.എ.മാർ നിയമസഭയിൽ നടത്തിയ കൈയാങ്കളി ക്ഷമിക്കാവുന്നതല്ലെന്ന് സുപ്രീംകോടതി.
ഇത്തരം പെരുമാറ്റങ്ങൾ അംഗീകരിക്കാനാവില്ലെന്നും എം.എൽ.എ.മാർ വിചാരണ നേരിടേണ്ടിവരുമെന്നും ജസ്റ്റിസുമാരായ ഡി.വൈ. ചന്ദ്രചൂഡ്, എം.ആർ. ഷാ എന്നിവരുൾപ്പെട്ട ബെഞ്ച് വാക്കാൽ പരാമർശിച്ചു. മന്ത്രി വി. ശിവൻകുട്ടിയുൾപ്പെടെയുള്ള അംഗങ്ങൾക്കെതിരായ കേസ് പിൻവലിക്കാൻ അനുമതി തേടുന്ന സംസ്ഥാന സർക്കാരിന്റെ ഹർജി ഈ മാസം 15-നു പരിഗണിക്കാനായി മാറ്റിവെച്ചു.
2015-ൽ ധനബിൽ അവതരണത്തിനിടെ നിയമസഭയിൽ നടന്ന കൈയാങ്കളിയെക്കുറിച്ച് ശക്തമായ പരാമർശങ്ങളാണ് തിങ്കളാഴ്ച സുപ്രീംകോടതി വാക്കാൽ നടത്തിയത്. പ്രഥമദൃഷ്ട്യാ സംഭവത്തിൽ കർശന നടപടിയെടുക്കേണ്ടതാണെന്ന് ബെഞ്ച് പറഞ്ഞു. എം.എൽ.എ. പൊതുമുതൽ നശിപ്പിക്കുന്നത് അംഗീകരിക്കാനാവില്ല. പൊതുമുതൽ നശിപ്പിക്കുന്നത് തടയൽ നിയമപ്രകാരം വിചാരണ നേരിടണം. ധനബിൽ അവതരിപ്പിക്കുന്നത് തടസ്സപ്പെടുത്തിയ അംഗത്തെ സംരക്ഷിക്കുന്നതിൽ എന്ത് പൊതുതാത്പര്യമാണുള്ളതെന്നും കോടതി സംസ്ഥാന സർക്കാരിനോട് ചോദിച്ചു.
ധനമന്ത്രിയുടെ വ്യക്തിത്വം എന്തായിരുന്നാലും ബിൽ പാസാക്കലിനാണ് പ്രാധാന്യം. ജനപ്രതിനിധികൾ എന്ന നിലയ്ക്ക് സമൂഹത്തിനു സന്ദേശം നൽകാൻ എം.എൽ.എ.മാർക്ക് ബാധ്യതയുണ്ട്. ഇതുപോലുള്ള പെരുമാറ്റത്തിൽ എന്തുസന്ദേശമാണ് അവർ നൽകുന്നതെന്ന് ജസ്റ്റിസ് എം.ആർ. ഷാ ചോദിച്ചു.
കൈയാങ്കളി നടത്തിയ എം.എൽ.എ.മാർക്കെതിരേ ക്രിമിനൽ നടപടിച്ചട്ടത്തിലെ 321-ാം വകുപ്പ് പ്രകാരം രജിസ്റ്റർചെയ്ത കേസ് റദ്ദാക്കാൻ തിരുവനന്തപുരം ചീഫ് ജുഡീഷ്യൽ മജിസ്‌ട്രേറ്റ് കോടതി വിസമ്മതിച്ചിരുന്നു. ഇതിനെതിരേ സംസ്ഥാനസർക്കാർ നൽകിയ ഹർജി ഹൈക്കോടതി തള്ളിയതിനെത്തുടർന്നാണ് സുപ്രീംകോടതിയിലെത്തിയത്. കേസിൽ പ്രതികളായ എം.എൽ.എ.മാരുടെ ഹർജിയും അന്ന് ആഭ്യന്തരമന്ത്രിയായിരുന്ന രമേശ് ചെന്നിത്തലയുടെ തടസ്സഹർജിയും സുപ്രീംകോടതിയിലുണ്ട്.
