Investment banker James Hooke’s offer to testify about private discussions he had with Attorney-General Christian Porter and the woman who accused the first legal officer of rape have raised questions about whether a police investigation was closed too early.
Melbourne University professor Jeremy Gans said a criminal court might allow Mr Hooke to describe conversations with Mr Porter and the woman, who committed suicide in Adelaide last year, under what is known as the uniform evidence law.
The decision on whether the information could be used at all would likely depend on how close the conversations took place to a sexual assault she claimed happened at a debating competition at Sydney University in 1988, he said.
