The Legislature has overridden Governor Burgum’s veto of a measure that changes how the state deals with unexpected federal funds.
Under current procedure, the Emergency Commission – made up of the Governor, the Secretary of State, the majority floor leaders of the House and Senate, and the two appropriations committee chairs – makes decisions on how the money is spent. And the Legislature’s Budget Section --- made up of all the members of the two appropriations committees – can either say “yes” or “no” to the Commission’s decisions.
HB 2290 would allow the Emergency Commission to make decisions on the first $3 million. From $3 million to $50 million, the Budget Section can make changes on the Commission’s recommendation. And after $50 million, the Legislature must be called into special session.

Bill gives state lawmakers more say in spending federal money

The Legislature has approved a measure designed to give lawmakers more say over how federal money, such as the COVID-19 relief money, is spent.
Under current law, the state’s Emergency Commission – consisting of the Governor, the Secretary of State, the majority leaders of both the House and Senate, and each chamber’s Appropriations Committee chairs – would decide how the money is spent. That recommendation goes to the Legislature’s Budget Section, which can only accept or reject the Commission’s recommendations without change.
The new measure would limit that procedure, so in amounts of to $50 million, the procedure remains the same, but it gives the Budget Section authority to amend. If it’s over $50 million, the full Legislature would have to approve it, in a regular or a special session.

Mississippi, North Dakota Pass Bills Targeting Trans Student Athletes on the Same Day


 
As a deluge of anti-trans bills make their way across the country, two states are one step closer to signing discriminatory legislation into law. On Thursday, Mississippi and North Dakota both advanced proposals that would prevent trans student athletes from competing in school sports in alignment with their gender identity.
Early in the day, the North Dakota House of Representatives voted overwhelmingly in favor of House Bill 1298, which would ban transgender minors under the age of 18 from playing on K-12 teams consistent with their sense of self. The proposal threatens to strip any state-funded entity of taxpayer dollars if it does not force students to participate according to the “sex indicated on the individual's original birth certificate.”

This isn't really a local control issue. It does not serve the interests of North Dakota well to have our state be a patchwork of conflicting policies on things such as guns. It makes more sense for us to develop, as a state, standardized and easy-to-understand policies that are, in turn, respected by political subdivisions. Support for "local control" in this instance means adding to the already byzantine maze of regulations gun owners must abide by.

Two bills attacking the transgender community will be considered during the upcoming legislative session in Montana.
Both measures were introduced by State Rep. John Fuller (R-Whitefish). The first, dubbed the “Save the Women’s Sports Act,” would bar transgender athletes from competing based on their gender identity in interscholastic sports, instead requiring them to participate based on their assigned sex at birth.
The second bill, which purports to “provide for youth health protection,” would have the state government interfere with personal medical decisions by prohibiting minors from obtaining certain medications or undergoing certain procedures used to treat gender dysphoria, even if their parents consent. The bill would also penalize any health care providers who recommend such treatments to people under the age of 18, with fines ranging from $500 to $50,000.

A West Fargo lawmaker believes some parts, at least, of the two Interstate highways serving North Dakota should have an 80-mile an hour speed limit.
Rep. Ben Koppelman (R-West Fargo) said in other states with an 80 mph limit, their number of fatalities have actually dropped at a higher rate than North Dakota’s have dropped.
"I believe what we can take away from that is, cars are becoming safer, highways are patrolled better, and people are driving safer," Koppelman said. "That allows us to go up with the speed limit."
But Koppelman said his bill takes into account road design. He said there would be some money in the bill for added barricades between lanes, and a re-design of some of the curves and inclines.
