Has President Biden initiated a managed phase out of domestic fossil fuel production, both federal and non-federal, before 2050?
The U.S. must phase out fossil fuel production as quickly as possible to meet global climate targets. During the campaign, Joe Biden offered some rhetoric in support of a phase out of fossil fuel production. Kamala Harris went even further, proposing an international agreement to address fossil fuel production. However, so far the Biden-Harris Administration has not implemented policies to phase out fossil fuel production.

The regulation of protected wildlife is likely to undergo a seismic shift as a result of the change in administrations. Whereas the Trump Administration took several actions to narrow the reach of wildlife protection statutes, the Biden Administration is likely to undo or revise many of those actions and seek ways to expand protection for sensitive species. In fact, it has already taken steps to do so. This increased focus on species conservation will likely result in additional wildlife avoidance, minimization, and mitigation obligations for project proponents. This article summarizes some of the recent changes in law, policy, and listing status relevant to protected wildlife under the Migratory Bird Treaty Act (MBTA), Endangered Species Act (ESA), and Bald and Golden Eagle Protection Act (BGEPA).

President Biden’s Day One Executive Order on climate action reconvenes an interagency working group to establish interim and final social costs of three GHGs: carbon dioxide, nitrous oxide and methane.
The social costs of these GHGs seek to quantify the negative externalities on an annual basis of a ton of these emissions.
The Biden administration will use the updated social cost figures to inform federal regulations and major agency actions and to justify aggressive climate action as the United States evolves toward a “100% clean energy” economy with net-zero GHG emissions.
President Biden’s resurrection of a relatively recondite cross-agency group charged with quantifying the nation’s contribution to climate change—the Interagency Working Group on the Social Cost of Greenhouse Gases (GHG) (Working Group)—ultimately may have the greatest impact across the federal government as the Biden administration pursues its climate goals. The Working Group’s updated cost figures will inform the way the government considers the economic impacts of climate change and, more importantly, how the government uses that data as a basis for action.

Among the important provisions of President Biden’s
Executive Order on Protecting Public Health and the Environment and Restoring Science to Tackle the Climate Crisis is the requirement to review and revise estimates of the social cost of carbon (and nitrous oxide and methane).  The order establishes a working group, co-chaired by the Chair of the Council of Economic Advisers, the Director of OMB, and the Director of the Office of Science and Technology Policy.  The working group has been directed to provide interim updates within 30 days, and a revised SCC, SCN, and SCM by January 2022.
There’s little doubt that the SCC will be greater than $50/ton, and it could be substantially higher.  In fact, the Bloomberg Environmental and Energy Report (subscription required) published an interview last Friday with Michael Greenstone, who is now at the University of Chicago, but was one of the developers of the SCC in the Obama administration.  As of last year, that formula already showed a SCC greater than $50.  However, Greenstone has just co-authored a new paper arguing that the appropriate interim SCC for 2020 would be $125/ton.
