A federal judge in Chicago has denied Society Insurance’s motions to dismiss three “bellwether” lawsuits filed by hospitality businesses that were denied coverage for revenue lost because of COVID-19 public health orders.
U.S. District Judge Edmond Chang, who was assigned a consolidated case by the Judicial Panel on Multidistrict Litigation, rejected an argument that government orders that restricted the use of commercial property could not be considered a direct physical loss covered by the policies. None of the three insurance policies contained a virus exclusion, as most commercial property policies do.

A Chicago federal judge has rejected a bid by Society Insurance to toss a mountain of lawsuits filed by Billy Goat Tavern, Purple Pig, Lettuce Entertain You and other businesses hit hard by the pandemic, a departure from recent rulings in other courts that sided with insurance companies.
The Monday ruling gives hope to dozens of restaurants, bars and other businesses — including many in Chicago and its suburbs — whose claims for business interruption insurance were denied by the company after COVID-19 and government-mandated shutdowns forced them to close or severely curtail operations. Their cases can now move forward in court.

The Illinois Department of Public Health (IDPH) today reported 1,665 new confirmed and probable cases of coronavirus disease (COVID-19) in Illinois, including 27 additional deaths.

- Cook County: 1 female 40s, 1 male 60s, 2 females 70, 8 males 70s, 1 female 90s
- DuPage County: 1 female 70s, 1 female 80s, 1 male 90s
- Kane County: 1 male 60s
- Knox County: 2 females 70s, 3 females 80s, 1 male 80s
- Madison County: 1 male 90s
- Marion County: 1 male 70s
- Winnebago County: 1 male 20s
Currently, IDPH is reporting a total of 1,177,320 cases, including 20,330 deaths, in 102 counties in Illinois. The age of cases ranges from younger than one to older than 100 years. Within the past 24 hours, laboratories have reported 61,400 specimens for a total of 17,721,561. As of last night, 1,488 individuals in Illinois were reported to be in the hospital with COVID-19. Of those, 361 patients were in the ICU and 172 patients with COVID-19 were on ventilators.

U.S. District Court Judge Edmond Chang ruled against Fond du Lac-based Society Insurance’s position that its insurance policies didn’t cover business-interruption claims tied to governmental restrictions imposed on restaurants. Society is a relatively small mutual insurer that specializes in property coverage for bars and restaurants.
