Kakamega court has released Senator Cleophas Malala on a bond of Sh500,000 or a surety of a similar amount.
The Senator has been charged with three counts of felony, assault, causing injury to an IEBC officer, robbery with violence and destroying property at Munami Primary School polling station during Matungu by-election.

Kakamega Senator Cleophas Malala surrendered himself to Kakamega Central Police station this morning to forestall earlier plans to have him arrested.
Malala, who arrived at the police station moments before 9.30 am, had indicated that he would present himself to record a statement over the chaos the rocked Matungu parliamentary by-election on Thursday last week.
The lawmaker was captured on video at a polling station confronting ODM leaders including Homabay Woman representative Gladys Wanga at Bulimbo Primary School tallying centre.
Amani National Congress candidate Peter Oscar Nabulindo clinched the seat followed closely by ODM’s David Aoko Were with United Democratic Alliance (UDA) candidate Alex Lanya finishing a distant third.

Even before the dust settles on the Matungu, Kiamokama and Kabuchai by-elections, a national date with electoral hell looms in 2022. Despite clear laws, procedures and seasoned politicians, the March 4 by-elections seemed to intentionally act out rather than avoid most of the electoral offences.
Article 81 of the Constitution states all elections must be free from violence, intimidation or bribery. The Constitution and at least five laws including the 2011 Acts on Elections, Political Parties and the Independent Electoral and Boundaries Commission and the 2016 Acts on the Election Laws and the Elections Offences directly govern the electoral process.

ANC candidate Peter Nabulindo has won the Matungu by-election.
Nabulindo garnered 14,257 votes, trouncing his closest challenger, David Were of Orange Democratic Movement, who got 10,565 votes.
Independent Electoral and Boundaries Commission (IEBC) Returning Officer John Kirui declared Nabulindo the winner of the hotly contested by-election.
Third in the race to replace the late MP Justus Murunga was United Democratic Alliance (UDA) candidate Alex Lanya who garnered 5,513 votes.

The poll was considered a three-horse race between ANC, UDA and ODM.
Other candidates in the race like Charles Kasamani (United Democratic Party) had 143, Paul Achayo (Movement for Democracy and Growth (MDG) 139 and Faida Auma (Maendeleo Chap Chap) 257.

“I am happy with the outcome of the polls. The people of Matungu and Kabuchai have made us proud and sent a powerful message for all to hear. The big victories can only mean that the grand march is now on,” said Mudavadi when he joined Matungu MP-elect Peter Oscar Nabulindo in celebration at Bulimbo Primary School moments after IEBC declared the ANC candidate, the winner.
He predicted more victories ahead, saying the region’s unity has been mirrored in the two by-elections earlier billed a contest pitting disgruntled National Super Alliance (Nasa) leaders – Mudavadi, Wetang’ula and Wiper’s Kalonzo Musyoka – on one side against ODM leader Raila Odinga and Deputy President William Ruto.

Residents of Matungu and Kabuchai constituencies go to the polls to elect new MPs this morning amid claims of a plot to rig the election.
Yesterday, ANC leader Musalia Mudavadi claimed some Independent and Electoral Boundaries Commission (IEBC) officials met ODM leaders to strategise on how to influence the outcome of the by-election in Matungu.
On Tuesday, Kakamega Senator Cleophas Malala made similar claims.
