The developers of Eighty Seven Park, the luxury building next to Champlain Towers South, proposed a payment of $400,000 to the association for the now-collapsed condo in exchange for expanded construction hours, a commitment to never publicly oppose the project or the developer, and an agreement to release the developers from all liability, two sources familiar with the matter confirmed to CBS News.
The proposal isn't dated, but according to one of the sources, it was made "about two years ago" at a time when residents were complaining about debris and "shaking" caused by the construction of Eighty Seven Park and raised concerns about its impact on the "structure" of Champlain Towers South. The offer came in the form of a term sheet presented from 8701 Collins Development, LLC to Champlain Towers South Condominium Association, Inc. It was never ratified.

The developer of a luxury Miami Beach high-rise next to the Surfside condominium building that collapsed last week was offering to pay $400,000 to the condo association of the older, smaller building two years ago, at a time when some homeowners were complaining about the proximity of the new building, the impact of vibrations and drifting debris, documents obtained by The Washington Post show.

SURFSIDE, Florida – When workers from Concrete Protection and Restoration and Morabito Consultants arrived to investigate and remediate work at Champlain Towers South, they found such extensive concrete deterioration and corrosion of reinforcement that some of the repair work couldn't be performed for fear it might affect the stability of nearby areas.
In a summary of work performed produced by Morabito Consultants on October 13, 2020, the company reported it had discovered several issues, including potentially deep deterioration of concrete near the pool area.
Full restoration and repair work "could not be performed" because the pool "was to remain in service for the duration of the work" and because the necessary aggressive excavation of concrete at the pool "could affect the stability of the remaining adjacent concrete constructions."
