Parliament introduced the pubs code owing to serious concerns expressed over many years about the relationship between the large pub companies and their tied tenants.

It has taken a little longer for the City of Carroll to hire and place a new Code Compliance Officer, but Rick Peugh of Farnhamville is on the job effective today (Monday). City Manager, Mike Pogge-Weaver, says he brings a wealth of experience to the newly-created position. Pogge-Weaver says the city is in the process of getting rental property owners registered and implementation of new processes for rental code compliance and inspections. Even though they anticipated being able to announce a new hire for the position in February, he says they have not really fallen behind at all.

What was the issue? Tenants have the right to a Code Rent Assessment Proposal (RAP) if during the previous 5 years there has been no concluded rent assessment (and/or, in the Code’s first 5 years, a rent review). The PCA identified arbitration cases in which Star declined to provide the tenant with a RAP because, it argued, the annual Retail Price Index (RPI) rental increase during the previous 5 years was a rent assessment or rent review under the Pubs Code. Further Pubs Code Declaration put in place to protect certain Pubs Code rights The PCA has approved a Declaration which pauses and preserves key Code rights during this latest period of restrictions. From: 12 January 2021 This Declaration is on identical terms to and has the same effect as the previous two Declarations that were agreed by regulated pub companies.
