Mumbai, Jan 30 (PTI) Relaxation of development rules cannot be permitted if it adversely affects public safety, the Bombay High Court has said while ordering the removal of seven mechanised cantilever car parking spaces (stack parking) constructed in a residential building here.
The Bombay high court has ordered the removal of stack parking in a Borivali housing society due to safety concerns. The court's decision came in response to a petition by an ophthalmologist who highlighted the dangers posed by the stack parking. Read more about the case and the court's ruling.
The court was shocked at BMC's reply that since "the building is less than 13 floors no fire engine access is necessary".
Bombay High Court: A division bench of Justices Gautam Patel and Kamal Khata noted that the stack parking system in the premises of the housing society in Borivali completely undermined the fire safety and public safety not only of members of the society but also of children, senior citizens, and perhaps even passersby.
