That we know of, craig. pete, what do we know about how this guy got those guns? that s the big question. we know he bought the assault rifle that was used in the attack. he bought it last year at a gun dealer in san antonio. the question is, was that a legal purchase? as far as we know, it came back as a cleared purchase when the gun dealer ran it through the national insta check system. the question is, should the fact that he had a conviction from a general court-martial for assaulting his wife and child disqualified him from owning a sgun because under federal laws, you can t have a gun if you have a domestic conviction or felony conviction. did the circumstances of the military conviction, were they entered into the system? the air force says yes. did they count as disqualifying factor? that s turning out to be a more complicated question. pete, do we know whether he ....

Assaulting his wife and child. it was a bad conduct discharge, not a dishonorable discharge. that s important. he would not have been able to buy that gun if it was properly recorded in his record that he had a dishonorable discharge. it is disqualifying under federal law for buying a gun. the question here is, did those other factors, the assault conviction and the fact that he served 12 months in detention, do those count as disqualifying factors under federal law? would they be the same as a felony, the same as a domestic violence conviction? not 100% clear. the conviction he had for assault is article 128 of the uniformed code of military justice. all that says is a sassault. if the people doing the background check at the fbi saw he had an assault conviction, it wouldn t necessarily be a disqualifying factor, unless they could look at his court records. we don t know what information is available to them. that s one big question here, ....

Military discharge, that do appear to be relevant are, domestic violence conviction and the fact that he served 12 months in detention, which would be the military equivalent of a felony. now, those are two factors that disqualify someone from buying or possessing a handgun under federal law. even a misdemeanor conviction or a felony conviction. the only direct reference to military discharges in the federal law is dishonorable discharge. that s disqualifying factor. his was a bad conduct discharge, but the other factors about it would appear to be disqualifying factors. so the question is, did the air force report those things to the system, were they checked when he went to get his gun? the gun store has acknowledged that he bought it last year at a gun store in san antonio. so that is one question. the governor has said he didn t have a handgun or a firearms permit in texas, but that s more ....

Not a disqualifying factor. and it absolutely is in the eyes of the world. steve, the senate intel committee turned down mike flynn s office to testify in exchange for immunity in that request, which was reported by nbc news and described by flynn s lawyer for request for assurances against unfair prosecution in what he called a witch-hunt environment. what is the sith significance of the decision to turn that down? i think it s an indication that senators burr and wearner who are earning a lot of respect in the sober and cautious way they re proceeding in this investigation, they don t want to get ahead of themselves and they re telling mike flynn s lawyer, we don t know what we want to ask yet and we certainly don t want to give weigh away points of leverage that they may have in their investigation. and if mike flynn is willing to tell a story now for immunity, then he certainly will be later. i assume they are guessing. ....
