"Mr. Goldnadel and Mr. Szpiner deplore being forced to initiate this procedure, but they cannot accept a denial of justice that offends reason and fairness well beyond the Jewish community of France," the two lawyers of Sarah Halimi's family said in a statement.
Francis Szpiner and Gilles-William Goldnadel, the lawyers of Sarah Halimi’s family, announced they wanted to “file a complaint against Kobili Traoré in the name of Esther Lekover, the victim’s sister,” since the Israeli criminal law can be applied to anti-Semitic crimes committed abroad and denounced by an Israeli citizen, which is the case of their client.

Sister of murdered French Jewish woman Sarah Halimi to ask Israel to try case

The sister of Sarah Halimi — an Orthodox Jewish woman in her sixties murdered in Paris in 2017 — will seek a trial in Israel after the killer avoided being tried in France on the grounds that was not criminally responsible because he had smoked marijuana before the crime, lawyers said.
The news comes as French-speaking Israelis were preparing a series of demonstrations across the country on Sunday to protest the ruling by one of France’s highest courts.
Halimi died after being pushed out of the window of her Paris flat by neighbor Kobili Traore, 27, who shouted “Allahu Akbar” (“God is great” in Arabic.)

The Jewish community in France is planning a mass rally in Paris on Sunday afternoon to demand justice for Sarah Halimi, a 65-year-old French Jew who was murdered in her home by a Muslim neighbor in 2017.
France’s high court ruled last week that Halimi’s killer, who shouted 
Allahu akbar and threw her from her apartment window, could not be prosecuted because he had taken marijuana before the assault and was therefore not in control of his actions. The ruling was met with derision from many corners and has led French President Emanuel Macron to call for changes to his country’s laws.

Israel’s Penal Law of 1977 contains a provision to extend Israeli criminal justice, under certain circumstances, to offenses committed abroad. This includes antisemitic attacks against “the life, body, health, freedom or property of a Jew, as a Jew, or the property of a Jewish institution, because it is such.”
The obstacles in the way of securing Traore’s eventual extradition to Israel would appear to be insurmountable. France has a strict policy against extraditing its own citizens for trial abroad, as US prosecutors know all too well from the 1977 sexual abuse case involving film director Roman Polanski. More recently, in July 2020, a court in New York refused bail to Ghislaine Maxwell, a party to the Jeffrey Epstein sex trafficking scandal, out of concern that her French citizenship would enable her to abscond to France, where she would remain as a fugitive from US justice.
