Huge task ahead for flood class action lawyers

Lawyers representing about 6800 flood victims in a class action against dam operators and the Queensland government are preparing for the next step in the seven-year legal fight.
Following on from a $440 million settlement reached between 2011 southeast Queensland flood victims and two of the three defendants in February this year, lawyers will now seek approval from the NSW Supreme Court for the massive settlement, which only constitutes about half of payout Maurice Blackburn is pursuing on behalf of its clients.
Lawyers' costs are yet to be determined, and will be discussed in Monday's hearing before Justice Christine Adamson in Sydney.

CLASS ACTION PAIN: Flood victim slams latest appeal

GOODNA flood victim Frank Beaumont remains hesitant on the prospect he might soon be compensated for the trauma despite a landmark settlement by two defendants on Friday.
Speaking with the Queensland Times, he said he was "cautiously optimistic" after learning the Queensland Government and SunWater had agreed to a $440 million class action settlement.
It was revealed on Friday the two had agreed to cover a total 50 per cent of the liability.
Seqwater, which is 50 per cent liable for damages, is reportedly pushing on with its appeal.
"We have had good news before which has been deflated," Mr Beaumont said.
The 7000-strong class action was first lodged in 2014 over the alleged negligent operation of Wivenhoe and Somerset Dams in 2011.

Queensland flood survivors still living with the effects 10 years on

A survivor of the deadly floods which struck Queensland ten years ago told Sky News residents are still living with the effects after losing “everything” they owned.

Frank Beaumont told Sky News after he evacuated when the floods hit in January 2011, 30 feet of water apparently covered his home and the whole street was "completely inundated".

“We have moved on to a certain extent, I still live in the same home, but financially we still struggle,” Mr Beaumont said.

“Insurance didn’t pay, it cost a lot of money to rebuild".

Mr Beaumont told Sky News survivors have been waiting eight years for the outcome of class action against SunWater and Seqwater over incompetent dam operations with an appeal set for May this year.

"The Campbell Newman inquiry actually found that the dam operators were not following the manual," he said.

"They were found guilty in November 2019 … but they’re not looking after the little people that got really damaged by their incompetence.

"We're still living it every day because there’s parts of your house, parts of your yard that remind you every day, we lost absolutely everything that we ever owned in that flood."
