Tea farmers defy court order, proceed to elect new office holders

Small-holder tea farmers in parts of Mt Kenya region held elections despite a court order suspending such polls in all the 54 Kenya Tea Development Agency (KTDA) tea factories.
The High Court had suspended an executive order issued by President Uhuru Kenyatta on March 12, directing the Tea Board of Kenya to conduct elections in all KTDA tea factories within 60 days.
However, tea farmers in Nyeri, Kirinyaga, and Embu counties went ahead with the elections barely a week after Murang’a County elected new directors. In Nyeri County, four out of the five tea factories - Gitugi, Iriaini, Ragati and Gathuthi - held elections, with the farmers picking six directors in each factory to represent their interests.

Tea farmers affiliated to Kenya Tea Development Authority (KTDA) in the Mt Kenya region will get a payout of Sh21 per kilogramme of green leaf up from Sh16 that has been paid in the last three years.
Already factories in the east of Rift Valley have informed their growers of the new amount following the government directive that they get 50 per cent of their earnings on a monthly basis.

Cabinet Secretary for Agriculture Peter Munya has said the government will zero-rate Value Added Tax on tea in order to boost value added exports as well as increase consumption of locally packed tea.
Though third in global tea production after China and India, Kenya leads in surplus tea exports to the world, sadly though, over 95 per cent of it is in bulk form.
This dismal value-addition is due to an unfavourable policy and tax regime, key being accessibility of tea by packers as they have to pay a refundable 16 per cent VAT upfront to access the tea, but which takes years to be refunded.

The Kenya Tea Development Agency (KTDA) has raised concerns on some provisions of the new Tea Act 2020.
This is even as KTDA acknowledged that the new law opened a new chapter for the development of the tea sub-sector and proved beneficial to the smallholder tea farmer.
“However, like most novelties, it contains provisions that offer conflicting indications, and whose impact will vary depending on the role played across the tea value chain,” cautioned Alfred Njagi, Kenya Tea Development Agency (KTDA) Management Services, Managing Director in a statement.
