The juristic principle comprising the bedrock of company law is the legal fiction that on incorporation, the corporate entity is clothed with a separate and distinct personality. It is a legal person distinct from its members.(3)
It is also well established that the corporate veil can be lifted or pierced when the corporation is used for fraudulent, dishonest and unlawful purposes.

(Bangkok) – The Malaysian Federal Court decision holding an online news site responsible for reader comments contravenes international human rights standards and will chill free speech in Malaysia, Human Rights Watch said today.
The court on February 18, 2021, held
Malaysiakini in contempt for five comments posted by readers even though the online portal removed the comments within 12 minutes of being notified of their presence. It imposed a fine of RM500,000 (US$124,000) – more than double the amount sought by the attorney general. The decision highlights the threat to free expression posed by section 114A of the Evidence Act, a provision passed in 2012 that creates a presumption that the host, administrator, or editor of the website on which content appears is liable for publishing that content.

News media conviction must not set precedent for curbing online expression in Malaysia

Access Now is deeply concerned about  a precarious precedent set today,
19 February, limiting  the right to freedom of expression online in Malaysia, after independent media outlet Malaysiakini was convicted by the country’s highest court for user comments published on its site. 
The
Federal Court of Malaysia charged the media outlet’s operator, Mkini Dot Com Sdn Bhd, with contempt of court on a motion moved by the Attorney General relating to the outlet’s alleged failure to moderate five comments on its platform deemed to scandalize the judiciary, fining it RM 500,000 (approx. USD 123,548). The user comments had been deleted by Malaysiakini upon notification by the police.
