Kerala HC Directs ECI To Hold Rajya Sabha Elections During Present Assembly Term

The Kerala High Court on Monday directed the Election Commission of India to hold elections to three Rajya Sabha seats from Kerala during the term of the present assembly.
A single bench of
Justice PV Asha directed the elections to the three seats, which are falling vacant on April 21, to be held before May 2, the date of results of the recently held assembly elections.
The Court passed the order allowing two petitions filed by the Secretary of the Kerala Legislative Assembly and CPIM leader S Sharma, challenging the decision of the ECI to defer the elections which were originally proposed on April 12.

Justice PV Asha, in her judgment, states,
"..
the intention is not to keep the seats unfilled but to complete the process of election before the retirement of the members, so as to have the full strength of members in the Upper House to represent the State."
Holding that any deferral of the election till after the results of the Assembly Elections were announced would result in a situation where there would be another electorate, the Court highlighted,
"The fact that it is upto the Commission to fix the schedule of election would not mean that the Commission can fix any date."

Thiruvananthapuram (Kerala) [India], April 12 (ANI): The Kerala High Court on Monday directed the Election Commission to hold elections to three Rajya Sabha seats from the state during the term of the present assembly.
The single bench of Justice PV Asha asked the Election Commission to hold elections on the three seats -- which are falling vacant on April 21 -- before May 2, the date on which results will be declared for the recently conducted assembly elections.
The court passed the order while hearing the two petitions filed by the Secretary of the Kerala Legislative Assembly and Communist Party of India (Marxist) MLA and former minister S Sharma challenging the EC's decision to keep in abeyance elections to the Rajya Sabha seats falling vacant from the state.
