Look, i think you have to look at both the question of whether he actually did it, whether he committed a crime. and while there is some evidence to that effect that mccabe and his attorneys have presented pretty powerful arguments to the contrary. but i think there's a second question you ask, which is is bringing a prosecution appropriate? and one of the ways you answer that question is by looking at similarly situated individuals and seeing if other people in similar situations have been prosecuted. and it doesn't take long to look through just the last few years and find multiple examples ...
