But the parties fell out over the amount of social housing that should be part of the development. Panuku wanted it capped at 30 per cent, but Ngai Tai Waipareira Housing wanted at least 67 per cent.
Tamihere announced in 2019 that Ngai Tai Waipareira Housing was taking legal action against Panuku, which he said was in breach of the Human Rights Act and discriminated against those shut out of the housing market.
In a statement, Panuku said its offer to make a contribution towards Ngai Tai Waipareira Housing’s legal bill was a pragmatic attempt to limit the cost to the council.

“Panuku is currently working with a preferred development partner and can confirm due diligence is underway,” it said in a statement.
“Until this has been completed around the middle of this year we are unable to advise further details regarding the future development.”
But Tamihere said that is an example of Panuku’s lack of transparency and accountability.
“The deal is done, so there’s no reason for confidentiality - it’s publicly owned land.”
Tamihere said the Papatoetoe site should be used for social housing, which is already in short supply in areas like south Auckland, otherwise the area will become gentrified.
