appeal. prosecutors were often filed what is called a prophylactic notice of appeal. it simply is a place holder that gives the justice department the opportunity to think through all of the issues, and there are frankly a lot of angles that will need to be considered before doj appeals. but usually you'll see that prophylactic notice of appeal filed early, before the file is run. it might mean if, we haven't seen that, yet that there is still robust conversation inside of the building, not only about whether to take an appeal, but what issues to take an appeal on. one option would be to outright appeal the judges order, but doj could also be more selective. they might appeal, for instance, the injection that keeps the criminal investigation from moving forward, while the special master's proceeding, a lot of different options that are in play here will know more once we see a notice from doj.
