Supreme Court Backs Clerics over New Jersey Worship Restrictions

The U.S. Supreme Court on Tuesday handed a victory to clerics battling New Jersey Gov. Phil Murphy’s (D) executive orders restricting houses of worship to 25 percent capacity, while secular businesses operate with no capacity limits.
The Thomas More Society, which represents Rev. Kevin Robinson, a parish priest, and Rabbi Yisrael Knopfler, who leads an Orthodox Jewish synagogue, announced in a statement:
The high court granted the 
writ of certiorari before judgment on appeal in the Third Circuit and vacated the original judgment of the United States District Court for the District of New Jersey, denying an injunction against the restrictions to Reverend Kevin Robinson and Rabbi Yisrael Knopfler who preside over small houses of worship in the state.

Ever since ACB joined the Supreme Court, there's been a dramatic reversal of the treatment of religious worship in the coronavirus era. 
Roman Catholic Diocese of Brooklyn v. New York was the first real pushback, but the SCOTUS majority is using it to carve out more territory for religious freedom in two cases, one involving the High Plains Harvest Church in Colorado, and the other involving a Catholic church and Orthodox synagogue in New Jersey.
The Colorado case is interesting because one of the arguments involved the different treatment accorded to Black Lives Matter riots.

Victory for More Houses of Worship


WASHINGTON, D.C. – After the recent ruling from the U.S. Supreme Court granting an emergency petition for an injunction pending appeal on behalf of New York City synagogues and Roman Catholic churches in Roman Catholic Diocese of Brooklyn v. Cuomo and Agudath Israel v. Cuomo, churches in Colorado, New Jersey and California have now received favorable court decisions regarding unconstitutional worship bans.
The High Court previously granted cert and vacated the lower court orders involving the emergency petition of Harvest Rock Church and Harvest International Ministry in their federal lawsuit against California Governor Gavin Newsom’s unconstitutional worship ban in light of Roman Catholic Diocese of Brooklyn v. Cuomo. However, after the district court failed to abide by the High Court’s instructions, Liberty Counsel filed a renewed application to the Justices on behalf of the churches asking for an injunction.

Ninth Circuit Rules for Religious Freedom in NV, Supreme Court Tells Lower Court to Rethink Ruling on NJ Houses of Worship

The Ninth Circuit Court of Appeals on Tuesday ruled in favor of Calvary Chapel Dayton Valley and Calvary Chapel Lone Mountain in their lawsuits against Nevada Gov. Steve Sisolak's worship bans. 
As CBN News reported in July, the US Supreme Court ruled 5-4 against injunctive relief for the Nevada churches while the appeal was pending in the Ninth Circuit. However, now that the high court has ruled in favor of New York City synagogues and Roman Catholic churches in Roman Catholic Diocese of Brooklyn v. Cuomo and Agudath Israel v. Cuomo, that created the mandate to strike down the Nevada governor's orders.

Ever since ACB joined the Supreme Court, there's been a dramatic reversal of the treatment of religious worship in the coronavirus era. 
Roman Catholic Diocese of Brooklyn v. New York was the first real pushback, but the SCOTUS majority is using it to carve out more territory for religious freedom in two cases, one involving the High Plains Harvest Church in Colorado, and the other involving a Catholic church and Orthodox synagogue in New Jersey.
The Colorado case is interesting because one of the arguments involved the different treatment accorded to Black Lives Matter riots.
In addition to these express exemptions, the State has extended the de facto exemption to the Protests. Thousands of protesters marched, chanted, and stood shoulder-to-shoulder for hours on end, all the while ignoring any semblance of social distancing. Far from prohibiting these gatherings, the State actively encouraged them. This is as clear an example of a departure from the principle of neutrality as it possible to imagine.

The U.S. Supreme Court on Tuesday ruled in favor of a North Caldwell Catholic priest and a Lakewood rabbi who sued Gov. Phil Murphy over coronavirus restrictions on worship services, with the court vacating a lower court ruling that was in Murphy's favor.
The move comes less than a month after the high court ruled in favor of New York houses of worship that challenged New York Gov. Andrew Cuomo's pandemic restrictions. Tuesday's action was not a ruling on the merits of the New Jersey case, but an unsigned order remanding it to the U.S. 3rd Circuit Court of Appeals and ordering judges there to reconsider their decision in light of the Cuomo ruling.

Supreme Court sides with church and synagogue questioning New Jersey mask mandate

The Supreme Court on Tuesday granted a New Jersey church and synagogue injunctive relief from Gov. Phil Murphy's pandemic restrictions on houses of worship after religious leaders protested against his orders requiring congregants to wear masks during services.
In an unsigned order released Tuesday afternoon, the court vacated a district court decision against the church and sent the case to the 3rd Circuit Court of Appeals for further consideration in light of the court's ruling in
Roman Catholic Diocese of Brooklyn v. Cuomo. In that case, the court found that New York Gov. Andrew Cuomo had violated the First Amendment by regulating church activity more harshly than businesses during the pandemic.

The U.S. Supreme Court on Tuesday told a lower court to reconsider a lawsuit brought by the pastor of a North Caldwell church and a Lakewood rabbi over their rights to conduct services despite limits on gatherings due to the coronavirus.
In an unsigned order, the justices, without dissent, told lower court judges to take into account its November decision rejecting New York’s attempt to restrict religious gatherings. The courts earlier had rejected the religious leaders’ request to block the state from enforcing its rules.
