Immigration officials began court proceedings Thursday to deport a Sacramento man to his native Iraq, where he faces trial, and most likely execution, for a terrorist murder that a federal magistrate says he didn’t commit.
U.S. Immigration and Customs Enforcement accuses Omar Ameen, who was granted U.S. refugee status in 2014 as a target of persecution and terrorist threats in Iraq, of defrauding the government by lying about his own alleged terrorist connections. Despite the magistrate’s findings, government attorney Sean Kersten told an immigration judge Thursday that Ameen “poses a danger to the community and a high risk of flight” if released on bond during the court proceedings.

Attorneys, community, demand Omar Ameen be released from ICE custody


The Council on American-Islamic Relations (CAIR) has joined the call for Omar Ameen, the Sacramento man accused of being an ISIS commander, to be released from Immigration Customs Enforcement custody.On Tuesday, the Sacramento Valley chapter of CAIR, alongside Ameen's attorney, family, friends, and supporters, gathered outside of the federal building downtown to bring attention to Ameen's case."We demand that ICE stop trying to strip him of his lawful refugee status and stop trying to deport him to Iraq, a country where he faces certain torture and death," Siobhan Waldron, Immigration Legal Defense Managing Attorney, said in a press conference.Ameen was accused of being a member of the Islamic State group, lying on his refugee application and of murdering an Iraqi police officer. The government's case hinged largely on supposed eyewitnesses who say he led the convoy into the Rawah district of Iraq's Al-Anbar province.But a KCRA 3 investigation showed that defense attorneys, after two years of intense negotiations and travel to Turkey, obtained what his public defender called "obliterating evidence." Cellphone data, cell tower "pings" and eyewitness testimony put him in Mersin, Turkey, within the hour of the Iraqi police officer's murder."They made him out to be the financial commander of ISIS, a military commander, a prolific maker of IEDs," said Rachelle Barbour, the federal defender who helped win Ameen's extradition case. "Everything in the book they threw at him, and the U.S. government gobbled it up."In a 30-page memorandum and order from U.S. Magistrate Judge Edmund Brennan in Sacramento, the court said that it did not seem possible that Ameen killed the officer in Iraq as evidence showed he was in Turkey. Brennan said the government's version of events made "little sense," and ordered Ameen to be released from federal custody immediately. Instead of being returned to his family, Ameen was taken into ICE custody, where he's being held on essentially the same charges Judge Brennan cleared him of. "Their assertion is ludicrous," Waldron passionately stated. "The facts are clear. We don't know why they are doing this and we demand answers."Ameen's wife, Khansaa, said she's been trying to explain to her children why their father hasn't been home."They all understand. They're hoping every single day that this is the day he will be released."Members of the Islamic community are praying that Ameen will be released in time to spend the last days of Ramadan with his family.Ameen's immigration hearing is scheduled for Thursday in Southern California.
