On January 13, 2021, the United States Supreme Court heard an oral argument in a pivotal challenge to the Federal Trade Commission’s (FTC) historic practice of obtaining monetary damages under a statutory provision that, on its face, allows for only injunctive relief.
AMG Capital Management, LLC v. Federal Trade Commission centers on the interpretation of Section 13(b) of the FTC Act, which allows the FTC to obtain an injunction when it has reason to believe the law is being violated or is about to be violated. Unlike other provisions of the FTC Act, such as Section 19, it does not expressly contemplate monetary awards. ....

In a year where the use of “unprecedented” became routine, COVID-19 dominated just about every aspect of life, and its impact on drug and device law was no less encompassing. As we bid adieu and good riddance to 2020, we pause, once again, to reflect on the most significant legal developments for our drug and device clients this year. Below is a brief recap and assessment of our top five developments in drug and device law for the year.
1. Snap Removal Continues Its Momentum
In April, the Fifth Circuit Court of Appeals joined the Second and Third Circuits in upholding snap removal. Snap removal occurs when an action is removed from state court to federal court before a forum defendant is served, and it is premised on a plain reading of 28 U.S.C. § 1441(b)(2). ....

Health Care Institution False Claims Act Liability Exposure

Many health care providers treating senior patients rely on Medicare reimbursement and undertake significant measures to ensure proper billing and compliant practices. However, providers across the country may soon be subject to increased liability under the False Claims Act (FCA) depending on the outcome of a case recently presented to the U.S. Supreme Court.
The Centers for Medicare and Medicaid Services (CMS) requires that physicians certify the medical necessity of many services as a precondition of reimbursement. For instance, CMS requires that physicians certify that a patient is terminally ill (meaning the patient has six months or less of life) before the agency will reimburse for hospice services. Likewise, CMS requires physician certification for certain covered post-hospital extended care services provided by SNFs. ....
