Sydney LGBTQI+ rights protesters will march along Oxford Street while the city's Mardi Gras is held elsewhere after NSW Health granted organisers an exemption from gathering restrictions.
The exemption means a court fight between NSW Police, who sought to stop Saturday's march, and the protesters will no longer go ahead.
Activist group Pride in Protest decided at the last minute to apply for an exemption to public health orders, approaching NSW Health Minister Brad Hazzard on Thursday afternoon.
Shortly before the court hearing was due to begin at midday on Friday, the group announced it had secured the exemption after agreeing on better contact tracing processes.

Mardi Gras protest march to go ahead in Sydney after last-minute Covid exemption granted


Shortly before the court hearing was due to begin at midday on Friday, the group announced it had secured the exemption after agreeing on better contact-tracing processes.
“This is a massive win for not only the right to protest but for the queer community to say that the fight against transphobia and homophobia cannot wait,” the group said in a statement.
Earlier on Friday, the chief executive of the Sydney Mardi Gras said his organisation was not going to support the march because it could not condone protests in violation of NSW public health orders.
The march is due to take place on Saturday afternoon ahead of the official Gay and Lesbian Mardi Gras parade, which has been moved to the Sydney Cricket Ground due to Covid-19 issues.

NSW Health has granted an exemption for Pride in Protest’s Mardi Gras march tomorrow, allowing the event to have up to 1500 people and exceed the current political gatherings limit of 500.
More than 1100 people have RSVPed for tomorrow’s march, with over 3200 interested.
This is the first protest to be granted an exemption by NSW Health. As a result, NSW Police have withdrawn Supreme Court proceedings against organisers.
The approval comes after significant community pressure, including letters of support from Greens, Labor and Independent Members of Parliament, as well as 78ers — a group of activists who marched in the first Mardi Gras in 1978.

The organisers of a protest march in Sydney to mark this weekend's Gay and Lesbian Mardi Gras say the event will go ahead despite opposition from NSW Police.
The march is due to take place on Saturday afternoon ahead of the official Mardi Gras, which has been moved to the Sydney Cricket Ground due to COVID-19.
Activist group Pride In Protest is among those organising the community march which plans to take the route of the original 1978 march down Oxford Street to Hyde Park.

A south Sydney council has rejected the state government's ultimatum to hand over a shopping centre carpark or see local residents' homes demolished.
At a meeting on Monday, the Sutherland Shire Council voted unanimously to knock back Transport for NSW's (TfNSW) demand that a council owned carpark in Jannali be relinquished so TfNSW can build a new commuter carpark on the land.
