Samoa's Parliament will convene next week

Under the Constitution, Parliament should convene 45 days after an election. Samoa's general election was held on 9 April.
The emergent Fa'atuatua i le Atua Samoa ua Tasi (FAST) party has a one seat majority in Parliament, following a court case on Monday.
The Office of the Electoral Commission and the Human Rights Protection Party (HRPP) sought a court order to stay the execution of a Supreme ruling earlier this week in which a sixth women's seat was declared void.
The motion to stay the execution of Ali'imalemanu Alofa Tu'uau's seat was rejected today in the Court of Appeal, and she will not be able to sit in parliament when it convenes.

Opinion: Why Samoa's Head of State does not have 'reserve powers' to revoke election results and call for new elections

It was reported that the counsel for the incumbent Human Rights Protection Party (HRPP), Aumua Ming Leung Wai, seeks to justify that declaration, by arguing the call for fresh elections was lawful because they were exercising their 'reserve powers'.
The Attorney General is also likely to make the same argument, and they have indicated that they are likely to engage the services of a Queen's Counsel (a foreign lawyer whose work has been given special acknowledgement by the British Crown) to act or advise on the matter.
In my view, this argument should be rejected, because the Head of State does not have any 'reserve powers'.

A legal view on Samoa's political stalemate


A Samoan law lecturer at Auckland University, Fuimaono Dylan Asafo, has looked at the questions surrounding the Samoa election stalemate, and offered these opinions on questions put to him by RNZ Pacific.
Fuimaono is a law lecturer at the Faculty of Law at the University of Auckland and holds a Master of Laws from Harvard University and a Master of Laws (First Class Honours) from the University of Auckland.

It's important to note that the confusion and controversy around the constitutionality of the Office of the Electoral Commission's activation of Article 44(1A) of the Constitution stems from the fact that the relevant provisions were poorly drafted.

One to go and no change in Samoa recount


With votes of just one district still to be recounted, the Electoral Commissioner says there are no changes in the results of Samoa's general elections.
Today the ballots for the remaining constituencies, bar one, on Savai'i have been recounted and all those declared winners last Friday have retained their victories.
The parliament, in that poll, was split evenly with the new FAST party and the incumbent HRPP both taking 25.
There is one independent.

The margin in the Sakega electorate was reduced to six from 13 but FAST member Fepulea'i Fasavalu Faimata held the HRPP incumbent To'omata Aki Tuileama.

Vote count underway in Samoa


Our correspondent reports the police presence was heavy at the polling places from the 8am opening.
On Savaii island voter turnout was heavy in the morning.
At Utulua, Asau, one of the chiefs, Masoe, said that voters cast ballots in the morning then go home and do their chores, like any other day.
Asked what he based his vote on, he said he voted for a stable and experienced government, one that has the interests of all of Samoa at heart.

He conceded he was surprised that government ministers were shaky after the pre polling.
