SCOTUS should hear case in which shackled defendant reenacted murder, with no defense objection, Sotomayor says

U.S. Supreme Court Justice Sonia Sotomayor dissented Monday when the high court refused to hear a case in which a shackled defendant reenacted a murder during his sentencing, with no objection from his defense lawyer.
The shackling was all too evident during petitioner Frederick R. Whatley’s reenactment, Sotomayor asserted in her dissent to the cert denial.
“Whatley’s chains clanked and rattled with every move, constantly reminding the jury that the court apparently believed he might do more than just pretend to kill someone in the courtroom if left unrestrained,” Sotomayor wrote. ....

Only damage after Fresh Air BBQ pit fire is some burnt meat


When a commercial fire call comes from the best “Barbecue Place” in the state of Georgia (or any other restaurant in Butts County), everyone responds. Such was the case shortly after noon on Feb. 4 when firefighters from Butts County, Jackson, Flovilla, and the Georgia Diagnostic and Classification Center all responded to a fire call at Fresh Air Bar-B-Que on Ga. Highway 42 South in Jackson.
Fortunately for all involved, the blaze that started when some meats being cooked caught fire was quickly extinguished, with the only loss being the meats themselves and some Brunswick stew. Fresh Air was closed for clean up for a few hours, but back open in time for Thursday evening diners. ....

A tanker truck carrying a load of oil overturned on Ga. Highway 16, on the bridge over I-75 on Thursday, Dec. 23, spilling its load down the highway entrance ramp and down into the grassy right-of-way. There were no injuries in the accident, which closed the ramp for much of the day for cleanup.

Man indicted for stealing $11 million while in state prison in Jackson


JACKSON – An Atlanta man currently serving a prison sentence at the Georgia Diagnostic and Classification Center in Jackson has been indicted for stealing $11 million while in prison.
Arthur Cofield and two others have been indicted for conspiracy to commit bank fraud and money laundering. Cofield is an inmate at the Georgia Diagnostic and Classification Prison in Jackson, serving a 14-year sentence for armed robbery. He is also currently under indictment in Fulton County, charged with attempted murder.
“Some prisoners aren’t interested in rehabilitation or paying their debt to society,” said U.S. Attorney Byung J. “BJay” Pak. “The allure of millions of dollars in gold, coupled with contraband prison cellphones, allegedly was enough for Cofield to commit a brazen million-dollar fraud scheme from the confines of his prison cell.” ....
