Texas DACA Lawsuit Threatens Many Work Permit Giveaways

Texas DACA Lawsuit Threatens Many Work Permit Giveaways
24 Dec 2020
A Texas judge may strike down President Barack Obama’s 2012 DACA amnesty for roughly 700,000 illegal migrants — and undermine other giveaway programs that allow U.S. employers to keep foreign workers in jobs needed by Americans.
In a December 22 hearing, the pro-migration supporters of Obama’s Deferred Action for Childhood Arrivals (DACA) amnesty asked District Judge Andrew Hanen to preserve the award of work permits, regardless of the economic impact on non-college Americans.
Hanen called the hearing after Texas, and other states filed a lawsuit to have the DACA amnesty declared illegal.

Despite Court Victories, DACA Faces Biggest Legal Test. No Immediate Ruling After Hearing on Fate of DACA Program
Despite court victories, DACA faces biggest legal test ahead of Biden presidency:
A federal judge who has issued scathing rulings against Obama-era immigration policies is set to review the legality of a deportation relief program for hundreds of thousands of young undocumented adults known as "Dreamers," just weeks before President-elect Joe Biden takes office.
Judge Andrew Hanen of the U.S. District Court for the Southern District of Texas will hold arguments on Tuesday in a lawsuit that seeks to wind down Mr. Obama's

Judge Hears Bid by Red States to Dismantle DACA

(CN) — Texas and eight other Republican-controlled states urged a federal judge Tuesday to end Deferred Action for Childhood Arrivals, sticking to their claims the Obama administration overstepped its authority in creating the program.
Started in 2012 through a memo from then-Department of Homeland Security Secretary Janet Napolitano, DACA allows certain immigrants brought to the country illegally as children to qualify for protection from deportation and allows them to get federal work permits and driver’s licenses that can be renewed every two years.

U.S. District Judge Andrew S. Hanen heard arguments on Tuesday in a Texas lawsuit that questions the legality of the Deferred Action for Childhood Arrivals (DACA) program. Both sides in the lawsuit asked for a hearing before the judge in Houston instead of holding a trial.
Texas joined eight other states to argue that President Obama went around Congress’ authority on immigration laws when he created DACA in 2012. We remember that even Obama himself admitted he had no constitutional authority to put DACA into place but he went ahead and did it anyway. After all, 2012 was the year he was running for re-election and there were Hispanic votes to pander for, you know. Obama presented his case for DACA because the children brought here by parents breaking the immigration laws of the United States were innocents in the act. Their protections are limited and must be renewed every two years.

In this Nov. 12, 2019, file photo people rally outside the Supreme Court as oral arguments are heard in the case of President Trump's decision to end the Deferred Action for Childhood Arrivals program at the Supreme Court in Washington.
A lawyer for states seeking to preserve the Obama-era program for so-called Dreamers asked a federal judge Tuesday to hold off ruling on a legal challenge to the arrangement until President-elect Joe Biden is sworn in next month.
With backers of the Deferred Action for Childhood Arrivals program expecting another adverse decision from U.S. District Court Judge Andrew Hanen, they pleaded with him to wait to see what the Biden administration does before issuing a ruling on a lawsuit Texas and other conservative states brought in 2018 to the original DACA plan issued back in 2012.
