Power over Montana s judicial branch is at the center of a debate over the constitutionality of a new law that gives the governor more options to fill midterm vacancies on the state bench. Senate Bill 140, which Republican Gov. Greg Gianforte signed into law last month, eliminated the Judicial Nominating Commission, an unelected body that greatly limited the governor s nominating power by requiring that all judicial candidates be selected from a pre-approved list. With the passage of the new bill, Gianforte can now fill vacancies, with state Senate approval, without having to select candidates that are recommended by an unelected Commission. 

Liberals ramp up calls for Supreme Court Justice Breyer to retire after he panned court packing in speech

President Biden will issue an executive order to create a bipartisan commission to study Supreme Court reform, including its membership and size; Peter Doocy reports from the White House. Many on the left had quietly hoped that Justice Stephen Breyer would retire in 2021, opening up a seat on the Supreme Court for President Biden to fill  but now some are waging a public campaign to pressure the liberal stalwart to step down.  The calls come in the wake of a speech Breyer gave to Harvard Law School students and alumni earlier this week when he warned that court packing – a term for adding seats to the Supreme Court to change its political makeup – could harm the rule of law in the U.S.
