An Indian American couple has filed a precedent-setting petition with the Delhi High Court, urging the Indian government and its Ministry of External Affairs to recognize same-sex marriages. The case was scheduled to be heard by the court on May 24 morning. Despite decriminalising same-sex relationships in 2018, the Indian government believes that same-sex couples do not deserve the same rights as “traditional”, heterosexual couples. “Living together as partners and having a sexual relationship by same-sex individuals is not comparable with Indian family unit concept of a husband, wife and children which necessarily presuppose a biological man as ‘husband’, a biological woman as ‘wife’ and children born out of the union,” the government said.
