The family of a disabled teenager with special Educational Needs has been at the court of appeal with a challenge against a councils School Transport policy. In march 2018, Leicestershire County Council announced it would not be providing transport for eligible children aged between 16 and 18. Instead, it offered Parents Money so they could arrange travel. But in many cases the cash is not enough to cover all the costs. In 2015 it became a legal requirement for all 16 to 18 year old5 in england to continue in education or training. Our disability new5 correspondent nikki fox reports its an early start for kirsty. Its all right. School today. She i517 and has learning disabilities and complex medical needs. Get dressed in a minute, all right . Her dad supports her full time. Even though some parents like kirstys contribute, the overall cost of School Transport for disabled students her age has significantly increased across england. Now her local council has had to make cuts. Its as if we are being punished for having a disabled daughter and that kirsty is being punished for being disabled. Its not her fault, she deserves her space in the world. You want that one, then. Grab it really tight. Like all students in england, kirsty has to stay in education or training until she is 18. Go, kirsty, go but between the ages of 16 and 18 councils are not legally required to fund transport. And its this loophole that is impacting families across england. We have heard from families who decided to pull their child out of school or college, or families who then had to give up work or reduce their working hours. So the consequences for individualfamilies can be really significant here. Today at the court of appeal kirstys family is challenging Leicestershire County Councils decision on the grounds of age discrimination. What the families lawyers are basically saying is that by removing kirstys acce55 to her specialist bus, and therefore her education, the council is in breach of her human rights. The local authority which operates these bu5e5 today said it wouldnt comment on the ongoing case, but remains committed to supporting families. It also said it needs to focus on providing Statutory Services in the face of increasing budget pressures. Bedtime. All right . For stephan he feels he shouldnt have to constantly justify his daughters disability in order to access the Vital Services they as a family need. Its an emotional drain because if we have to go through all this again and it all comes out again about kirstys disability, the impact that it has on us as a family. Sorry, im getting emotional. Its quite difficult. Its quite difficult because this is my daughter. Ok . Hmm. Stefan drexler, kirstys father, ending that report by our disability correspondent, nikki fox. It can stop people going to the doctors because theyre embarrassed or theyre afraid, what would you say to them about that, what would you say to people .
