They describe the young boy, the 10yearold son phillip, as being found on the remains of a mattress remains of a bed where there had been so much burning that the whole bed frame had been consumed by fire so had most of the mattress and even the floor underneath it all. Wint is actually going to be in front of the judge here in the superior court of the district of columbia. Think about, tom, the other people he was found with. Five other people i understand. One, the Authorities Say, is his brother. What about the other folks . Do we know who he was with and why . Reporter we dont know the details of why he was with them. We dont know who all they are. At the moment theyre not being charged. They havent yet come up with charges on those. Thats the word from the authorities here. Were very much hoping one of the u. S. Attorneys is going to come out and have a word to say after this is all done. Maybe well get more answers then. But this does seem to be complicated in the sense we dont really know the details. My experience tells me authorities are also sorting through the details, trying to figure out what they can be told by these various people. So i would expect them to be relatively cagey until somebody opens up and tells them something that really explains all the details of what happened. We dont even know if any of the others were involved in this part. We know right now mr. Wint is the only one charged in these four homicides. Just so tragic as they focus on the suspect here. You got to remember the family and these four people and this little 10yearold boy who the Authorities Say look like he was tortured before he was killed. Tom foreman, thank you very much. One of wints former attorneys says thats not the client he knew. He describes wint as a gentle man, not mean, a man trying to find his way, and a patriot, the kind of guy, he says you take to your grandmothers house for dinner. But wint does have a lengthy criminal past including assault and burglary charges. Investigators first connected wint to the murders after finding what they say is his dna on a pizza crust left at the crime scene. His former lawyer says even if thats true it doesnt mean that he went inside the mansion or that he killed anyone. Listen. I know him to be a kind gentle, nonaggressive person someone you wouldnt mind your grandmother going to lunch with. Hes not the guy that did this. I met with him many times. Ive observed hundreds of thousands of people in my life completed 30,000 cases in court. When im sitting across from a person hours at a time i can tell theyre kind and gentle. He was not a mean aggressive person at all. He was a young man finding his way, a student at prince Georges Community college. He tried to get into the marines. He was patriotic. Ive had many cases the dna findings have been thrown out of court. We dont know who conducted this dna and how it was done. It needs to be scrutinized. Why are the police letting out piecemeal, little bits of evidence in a chinese water torture method . They need to conduct themselves in court and not keep talking to the media, trying to brand this guy. So that is wints former attorney who represented him in six different incidents. Joining me now to discuss, defense attorney randy zeleny. Also with with us troy slaten. Thank you for being here. Troy lets begin with you. If this pizza crust is the only dna that they have in this case right, its sort of shocking to people that if he was in this house for hours and hours, how is there no other dna . But lets say its just the pizza crust. Is that enough to get a conviction . It may not be enough to get a conviction but it may be enough for probable cause to hold him to answer to these charges, which is a much lower standard. Of course the dna will have to be examined to see how it was collected and all the other evidence. Circumstantial evidence is sufficient in a case like this. Randy, what do you think . Its so difficult to say. What were talking about, first of all, a little evidence 101, the difference between direct evidence and circumstantial evidence. Its as simple as, if you want to know whether or not its raining outside, well if youre outside and the rain is falling on you, thats direct evidence of rain. If you go into the subway and its not raining and youre in the subway and see people coming down and theyre wet and they have umbrellas and their umbrellas are wet, you didnt see it rain you dont have direct evidence but you can naturally infer. So where does this dna on pizza crust fall in there . Look not to be flippant but if thats all that they have can you say that theres no other plausible explanation . It is his former boss. Maybe he was in the neighborhood stopped by. They had pizza. Dont forget the movie my cousin vinny. You had the wrong people. Those things can happen. Simply dna, not enough. Troy he fled. He knew the authorities were going after him. The Authorities Say when they caught him last night, he had 10,000 cash on hand. Well thats more circumstantial evidence. The fact he fled thats called consciousness of guilt. In every single criminal trial when a person leaves the scene, when they run, when they try and evade the police theyre allowed a specific jury instruction that the prosecutor always gets and is always afforded that says that when somebody leaves that means its consciousness of guilt. They knew what they had done was wrong and they were trying to get away from the authorities. Randy. Go ahead. No go ahead. Jump in. In a circumstantial evidence case every other explanation has to be excluded to a moral certainty. Flight they found him in maryland. He went to new york and then came back. I would argue thats what risk of coming back. The fact he had ten grand in cash on him. Again, he could have been going to buy a used car. So you cannot at this particular moment exclude every other explanation to prove his guilt right now. Troy i think its interesting. Look, he has a criminal record as we talked about, but no significant history of violence. Theres no murder charnlsges, no aggravated assault, no kidnapping. You say criminal acts tend to increase over time. Explain what you mean. Thats true. His former attorney said oh this is a guy that would be great to have lunch or dinner were grandma. Well in 2010 he was caught with a machete. I dont know about mr. Zelin, but i certainly wouldnt want a guy coming to dinner with my grandma with a machete. Criminals very often start small and get big. Randy, put yourself in the shoes. Youre going to be the defense attorney okay. What do you do . The first thing im going to do is look at evidence. Right now all we have is the dna on the pizza crust. As my colleague indicated, were going to tear apart that from how it was collected to how it was analyzed. Do we know thats all they have . Thats all we know right now. Again, i would not argue that was consciousness of guilt from a risk of flight standpoint. I would hope that my client made no statements once he was taken into custody. Right now we dont have a murder weapon. Right now we dont have a motive. So weve got a long way to go before we Start Talking about a conviction certainly beyond a reasonable doubt. The bulletin is based on unsubstantiated information from an informant who claims to have obtained it from members of the bandidos and another group called the black widows. You know the Texas Department of Public Safety issued this warning, saying they believe some members of the bandidos were actually giving the group grenades and c4 explosives to retaliate against police for what happened in waco texas, over the weekend. I want you to listen to what the Waco Police Department has to say about this new threat. The incident that occurred here sunday afternoon was an absolute tragedy. However, those of you that were there know that we did absolutely nothing to start that. We would ask you to remember that and remind you that although you have totally different ways from us Law Enforcement did not start the melee that occurred at twin peaks on sunday afternoon. Reporter obviously the message is lets keep the peace here. Authorities not just in waco by the way but authorities all over the state of texas are on alert since this shootout happened over the weekend. So yur in moure in mingus. A rally was planned here. Obviously, because of what transpired last sunday, its been canceled. What is the sheriff doing there to prepare in case anyone shows up with any ill intentions . Reporter the sheriff tells us that he is prepared for the worst, but again, hoping that nothing will happen hoping for the bestcase scenario. Hes hoping it will be a quiet weekend. One of the biker groups involved in sundays deadly shooting over in waco texas, was the cossacks. They typically have a meeting, a rally in this town in mingus every year. This year after what happened they decided to cancel it. I want to show you a sign here in town. It says the cossacks have agreed to cancel the mingus employee blowout, which is the rally, for the safety of mingus. The road leading to the cossacks property is blocked off. Its just down the street from where we are. So far, were told that no one has showed up and the hope here is no one else will show up and that things stay calm in this town. All right. Alina machado live for us there. Thank you for that. And police say 170 bikers all of those who were arrested in waco on sunday came there to be violent. But an attorney for one of those men behind bars says his client was a bystander, not a brawler. Well he was in the parking lot. The meeting hadnt started. He heard a gunshot, fell to the ground, then the melee broke out. Thats all he knows. He was there to attend the meeting. So what did happen . Obviously there are a lot of different accounts depending on who you talk to. Our very own gary tuckman sat down with a waitress from the twin peaks restaurant where the bikers had gathered. She says she was there when the first shots were fired. Two women who worked at the twin peaks restaurant one of them a waitress who was there when the shots rang out. Amy, who doesnt want her real name used doesnt want her face shown for her safety says the trouble started in the parking lot. First it seemed like a simple fistfight. Were they yelling and screaming . Theres a little bit of yelling. You couldnt hear exactly what they were saying. You could hear a little bit. Amy says almost all the bikers were on a patio outside of twin peaks. A patio that fits about 100 was standing room only. Next thing you know a gunshot went off. A couple fired after that. What are you thinking . I honestly didnt know what the hell was happening. I didnt know if gunshots were going to be flying towards the building or just back and forth between who was shooting. There was a lot of screaming. You hear all of us oh my god, whats going on just start screaming and take off running to the back. Some of the people were down squatting and running at the same time or crawling to the back. Employees and some customers hid inside a walkin refrigerator and freezer. How many people were in there with you . There were seven waitresses and then one customer and like six or seven, maybe eight of the kitchen staff and back of house staff. It was pretty scary. Because we were like and we were trying to put stuff in. On the refrigerator where we were, we had racks to move in front of the door to kind of barricade ourselves. So if anyone were to come in trying to actually get after everybody, we at least were protected. But what were you discussing while you were in the refrigerator with everybody . Just if we were even going to make it through. After about 10 or 15 minutes, bikers outside the refrigerator, at least some of who ended up being arrested told them the coast was clear. You walked out in a line your hands up. Who told you to put your hands up . The police did. Somebody up in the front was told to put their hands up so they passed the word back. We were just passing it back to each other. You went out with your hands up. You must have been very relieved. A little bit, but it was nerve racking having guns pointed at you. By the police. Uhhuh. Veronica williams left her job as a bartender a week before the shooting. So its your opinion that the police gave your bosses fair warning, the possibility of a bigtime trouble with these guys. Yes. Veronica says she was working in the restaurant last month when cops came to talk to the bosses. Tell me what the Police Officer told your managers. He said there was conflict between some of the motorcycle clubs and it would be in the best interest to not have any biker events. But events continued to be held. The top manager at the waco twin peaks did not return our phone calls. Today amy is grateful to be alive. I look back and were all beyond blessed it wasnt worse than it already was. Its something weve heard far too much about lately across this nation. The feds say one of these men in california tried to go to the middle east, that they both used social media to discuss potential terror attacks, and that they both wanted to die as martyrs. Both of them are due in court this afternoon. As soon as we get more updates, well bring them to you. Also right now, isis terrorists are even closer to the iraqi capital of baghdad, first taking ramadi now taking a town near a very Critical Military base. President obama saying quote, i dont think were losing referring to the war against isis. But these maps paint a different picture. Last year, this was isis presence across the middle east. The group scattered across syria and iraq. Today, look at this. A lot more red because isis has taken a lot more territory across the region. Their presence is growing in libya, tunisia, in yemen. As for syria, the terrorists are now apparently in control of half of the entire country. Joining me now to talk about it the director of the center for Foreign Policy studies at the heritage foundation. Also with us in washington excuse me steven is also a former special army forces officer. Also with us in washington is a senior fellow at the education for peace in iraq. Gentlemen, thank you both for being here. Ali, i want to begin with you. You penned a very very interesting oped in the new york times. You argued that even with 50 of syria under isis control, even with the fall of ramadi and fallujah in iraq you say that people are overblowing the advances that isis has made. How can that be . Well poppy, its good to be with you. I think if you look at iraq theres certainly a mixed picture when it comes to the war against isis. Even though isis took control of ramadi last sunday you see that in other parts of the country over the last five to six months isis has been firmly contained. It has been pushed back. It has been rolled back. And it decided as a result of all of these setbacks to shift its effort to ramadi and anbar. Therefore, i do not see the shift to anbar as a sign of strength by isis. It is in fact a sign of desperation. Thats what i say in my oped. That part really stood out to me. You write, the attack on ramadi was an attack of desperation, not strength. I wonder why you come to that assessment. Because of the situation in ramadi, we do have to keep in mind that isis did not blitz into ramadi. The city did not fall under isis control in three days. It has been contested by isis since january 2014 which is about 16 months. Isis has fought antiisis forces in ramadi including Iraqi Security forces and tribes against isis for 16 months. Therefore, these forces were very exhausted. They isis knew that issue, knew those difficulties, and saw ramadi as a target of opportunity. It was not necessarily a show of strength by isis. Steven we did see a coalition and u. S. Forces come out successful in kobani. Ultimately they were able to push isis out. You did, at the same time have mosul fall in june of last year. Do you agree with ahmeds assessment that perhaps the media and others are overblowing this . This doesnt mean that because ramadi fell that all of iraq is going to fall apart. Hes right. It did take them longer to do. They showed some great sophistication waited until there were sands storms which lessened the effect of the american air power. They used some very sort of innovative suicide vehicles to do bulldozer things of that nature. These guys are thinking. So hes right, it isnt that they just rolled through like they did when they first came back into iraq. But this isnt a sign of a weakness in my mind. Its a sign theyre maturing which is dangerous. Youre a former pentagon official, right . So i really want your take on the president and what we heard the president say in his interview this week to the atlantic, saying the United States is not losing the war on isis. I wonder from your standpoint of formerly being at the pentagon, how does he come to that assessment . Wheres the Tipping Point . Well i have to say that the president is being particularly optimistic in his assessment. I would agree were not losing the war to isis but unfortunately, were darn sure not winning it either. We really need to step up the air campaign. We need of more of it. We need to embed some American Special operators with those local forces on the ground. The Cable Network tlc has decided to pull all episodes of the hit show 19 kids and counting. Theyre pulling it off the air. This happens as one of the stars of that show has apologized after reports surfaced that he allegedly molested young girls while he was a teenager. Joining me now, cnns senior media correspondent brian stelter. Whats the network saying . Sorry about that. Im trying to hop off the phone with an executive at the network. Theyve pulled all episodes of 19 kids and counting from their schedule. Theyre doing that effective immediately. The statement says they put all episodes currently on the air, includeing some aired today. The statement goes on to say this is really a tragic situation for the family and a very difficult situation for the family. They say their thoughts and prayers are with everyone involved in the situation, including the family and the victims. One of the complicating factors here is that among the alleged spring victims in this case are family members. Thats something tlc says it did not know. Apparently no one at tlc had seen this Police Report that was published by in touch weekly magazine yesterday. Thats what kicked off this real scandal and crisis. The real phrase from the network is family in crisis. The cameras werent going to be there today. Right now theyre on a break from filming. Its not as if there were new episodes being produced right now. Obviously this is one of tlcs biggest shows. They would have been working on a new season that would have been premiering in the coming months. I think at the moment, theres no word on whether theyre doing that. Theyre not cancelling it today. Well the state department has released its first batch of Hillary Clintons emails, detailing the aftermath of the 2012 benghazi consulate attack. Nearly 300 of these emails were made public today. This is all on the heels of the backlash against the former secretary of state after it was revealed he exclusively used a private email server to conduct official business. The 2016 president ial candidate reacted today to the release of those emails while she was on the campaign trail in new hampshire. She said quote, the information in the emails was handled appropriately. Well first of all, im glad that the emails are starting to come out. This is something ive asked to be done as you know for a long time. Those releases are beginning. I want people to be able to see all of them and it is the fact that we have released all of them that have any government relationship whatsoever. In fact the state department have the vast majority of those anyway because they went to what are called dotgov accounts. Im aware that the fbi has asked that a portion of one email be held back. That happens in the process of freedom of information act responses. But that doesnt change the fact that all of the information in the emails was handled appropriately. All right. Officials say that were going to get more of those emails. Theyre going to roll them out from the state department on an ongoing basis. Cnn investigative correspondent chris fraits joins me in washington. Chris, she came forward, she talked about these. Its really important to qualify this. Just noting right, these are emails that she handed over to the state department. Theyre poring through them theyre releasing. Thats right. These are only 300 of the 30,000 emails that shes turned over. And they focus exclusively on benghazi and libya. And democrats were quick to point out theres no evidence here of a smoking gun. Theres no stand down order. There was no evidence that any guns were being run through benghazi. They say this is just more evidence that republicans are spinning crazy conspiracy theories. Republicans are quick to point out a number of these emails raise questions about security in benghazi and in libya. They point to an august 24th email for example, that says there were some warning signs of a deteriorating security situation. They want to know why did that happen. And the other thing here poppy, thats really interesting is you get some sense of how Hillary Clinton ran the state department. A few days before christmas, two of her top aides were set to go and testify on capitol hill. She couldnt make it. She had fallen down and suffered a concussion. She writes to them so ill be nursing my cracked head and cheering you on as you remain calm and carry on. And theres also another email from a top aide to hillary that talks about, you know, some of the things that she has going on. She needs hillary to come in and look at some gowns and blouses. She also needs hillary to make a call to one of the officers who was hurt in benghazi. Then they also need to decide what to do with an oscar exhibit that may have looked like it was at the Clinton Library in little rock. You get a sense of how broad and wide of a schedule she has. Its a very interesting look into how she ran the state department. Lots more emails are going to be coming out over the next few months. This is just our first look at libya and benghazi in particular. Chris, thanks. Appreciate it. Lets talk about it more with cnn political commentator Michael Smerconish. Were right next to each other on saturdays. Nice to be at the desk with you. What do you make of her reaction . She addresses it on camera. She gets asked about it today in new hampshire. No blood drawn is the headline i would put on this. You correctly identified the issue why its ridiculous to say was there a smoking gun in any of this. Were talking about information she put forth. Presumably if it were the smoking gun, its not the information shed have handed over to the state department to begin with. This is the first of many releases. Its going to be on a rolling basis instead of one document dump. At a certain point, this will begin to be perceived as why do they keep going over all of her information with such a finetooth comb if theyre not doing likewise with other candidates. Either something needs to be generated in these releases or republicans run the risk of being perceived as overplaying the benghazi card which i think they did in 2012. You point out these are emails shes handed over. Right. We ever going to get all, all, all of them . I guess, you know, a critic would say to the extent that there are emails out there that would somehow look damning of her conduct in office, every email is a twoway communication. So theres someone else out there who either sent it or who received it and in the era where everybody writes a memoir maybe at some point something will be forthcoming. That and the fact that they say when wint was captured he was captured in concert with this other vehicle, that there were money orders in the car that had been purchased that others in the group said had been purchased with some of the money from the house. Theyre saying thats the case. Now, the defense said look the pizza, by the governments own case ordered wednesday evening. The government says the murders occurred on thursday. Maybe he was at the house, but had nothing to do with what happened thursday. The judge said he would not buy that, saying there is circle evidence what it is but a lot of it. Thats why he said, no.
